12.28.2009 Elettricità Regulation of the aggregation of electricity measures and the relative incentive measures.
With reference to activities to aggregate electricity measurements for the dispatching service , the Authority proposes amendments to payments made by dispatching users to the distribution companies which Terna uses to perform its activities and it proposes incentives to regulate the performance of the activities by the distribution companies. In detail the Authority intends to leave aggregate payments for feed in and withdrawal already defined in the settlement code unchanged, while it intends to introduce an aggregate payment for conventional profiling of withdrawals, to be applied to each withdrawal point not treated on an hourly basis. As concerns incentives, the Authority proposes adjusting the payments made to each distribution company on the basis of the levels of service and providing automatic compensation paid by distribution companies directly to dispatching users in cases of failure to comply with the deadlines, format and content of the communications due to them.

12.22.2009 Elettricità Amendments and additions to Resolution No. 113/06 concerning recognition, in accordance with Title II, point 7 bis of CIP measure No. 6/92, of costs resulting from compliance with obligations pursuant to article 11 of Legislative Decree No. 79/99 for the year 2008.
The Authority opens consultation on the procedures for quantifying the Vn value for each green certificate which CIP6 regime producers purchase satisfy the obligation pursuant to article 11 of Legislative Decree No. 79/99. The procedures proposed by the Authority generate a Vn value of €60.1 MWh.

12.14.2009 Gas Amendments to article 11 of Resolution No. 167/05 of 1st August 2005, relating to provisions in cases of failure to use regasification capacity.
On the basis of observations received concerning the systematic underuse of capacity at the Panigaglia regasification terminal and in the light of the start of activities at the new Rovigo regasification terminal, the Authority has started a consultation relating to the failure to use the regasification capacity authorised. The Authority therefore proposes amending article 11 of Resolution No. 167/05: in order to encourage the best use of capacity: 1. by establishing a minimum threshold of 95% for the use of booked capacity; 2. by establishing that users who do not intend to use the capacity should make the proportion not used or the number of moorings not used available before programming deliveries of LNG, by the end of the month M-2.

12.10.2009 Elettricità Mechanism for the compensation of costs incurred by providers of the transitory service for safeguarded categories for receivables not otherwise recoverable.
The Authority opens a public consultation concerning the compensation of costs incurred by providers of the transitory service for safeguarded categories for receivables not otherwise recoverable with the objective of defining: the general criteria and the participation in the compensation mechanism, the level of receivables not otherwise recoverable and the procedures for recovering costs relating to those receivables. The date of the consultation is set for 11/01/2010.

11.19.2009 Elettricità Prices differentiated by hour bands for sales to end user domestic customers in protected categories.
The objective of this consultation document is to identify gradual means, of a transitory nature, that can be used to apply electricity and dispatching prices to end user domestic customers in protected categories that are different for different hourly bands and groups of months (two-hourly pricing), designed to educate end user customers in the passage from one-hourly to two-hourly prices. Gradual means, of a transitory nature, to apply two-hourly pricing to end user domestic customers are outlined, with attention paid to the potential effects on the retail market.

11.19.2009 Elettricità Proposals to increase output useable during low load hours for domestic users with measurement of withdrawals by hour bands.
This consultation document illustrates the underlying assumptions of the regulations introduced and the main issues and orientations of the Authority concerning the proposal to support the introduction of compulsory two hourly prices for domestic users with contractually committed consumption of not more than 3 kW, designed to relax electrical constraints which might prevent or limit the movement of loads to low load periods.

11.11.2009 Elettricità National standards for communication between electricity sellers and distributors.
While regulations on communications between distributors and sellers of electricity shall take account of previous measures applied, they may also benefit from the experience acquired and regulations applied in the gas sector. The Authority therefore proposes specific provisions and operational instructions and also that time stages already planned for the gas sector are followed, i.e. a short term minimum solution using certified electronic mail and a final evolved solution which uses the XML vector. The Authority also presents proposals for the sequence of information flows and minimum data to be exchanged on the basis of the quality code for the electricity sector, the reasons for the inadmissibility of requests, the periodic update of information, the verification of information and of data exchanged and implementation times.

10.29.2009 Gas Method to estimate gas consumption following malfunction of a metering unit.
The Authority starts consultations to determine, by the end of 2009, the methods to be used to estimate natural gas consumption following the replacement of a metering unit due to errors in readings greater than the admissible tolerances. Critical points concern defining the error percentages recognised, the total volumes and the volumes to which the recognised errors should be applied.

10.29.2009 Elettricità Gas Final recommendations to harmonise and increase the transparency of invoice documents for electricity and gas consumption.
The Authority gives its final recommendations for the harmonisation and transparency of invoices for consumption of electricity and gas. A standard invoice is proposed, which is the same for both electricity and gas supplies and for different types of customer (domestic and other), consisting of a summary part and a detailed part, to be sent compulsorily on separate sheets.

10.09.2009 Elettricità Gas Compliance with Council of State decisions numbers 699/09, 701/09, 702/2009, 703/09, 778/09, 785/09, 786/09, 787/09, 788/09, 790/09, 792/09, 749/09 and 1191/09, relating to administrative and accounting unbundling. Additions to Authority for Electricity and Gas resolutions No. 11/07 relating to limitations on functional unbundling obligations.
The Authority starts a consultation for the issue of a resolution relating to administrative, accounting and corporate unbundling. The measures regard: 1) compliance with Council of State decisions of 16th December 2008 concerning challenges made by some companies against resolutions No. 11/07 and No. 253/07; 2) the introduction of measures to constitute a “combined system operator”, pursuant to resolutions No. 2003/54/CE and No. 2003/55/CE; 3) conditions for the joint operation, with no functional unbundling obligation, of network activities subject to tariff regulation.

10.07.2009 Elettricità Authority for Electricity and Gas orientations for the regulation of electricity cooperatives in relation to the liberalised electricity market.
The Authority starts a consultation to regulate electricity generation and distribution co-operatives in accordance with the complete liberalisation of the market. In this consultation document the Authority proposes to regulate co-operatives on the liberalised market by making a clear distinction between aspects concerning grid functions and those connected with electricity supply. Although it allows for advantages for members who generate and distribute electricity through their own grids, the Authority proposes requiring observance of the physical role of the distribution grid, the operation of which is independent of the nature of the users.

08.06.2009 Gas Survey of allocation processes in the natural gas balancing service.
The Authority starts a survey of regulations currently in force with regard to metering and estimates of gas flows charged to users of the pipeline network in order to assess whether to make amendments to it as part of the revision of balancing regulations and also to identify the main critical points in the estimation procedures currently in use.

08.05.2009 Gas Urgent action to amend balancing and settlement regulations for the natural gas storage services in accordance with Decree Law No. 78 of 1st July 2009.
As part of consultation over the possible reform of balancing regulations and in compliance with Decree Law No. 78/09 on the introduction of peak services and flexibility for end users including industrial users, the Authority makes interim proposals until a specific balancing market is created, to increase the supply of short and very short term flexibility instruments and their use by operators. In detail the regulator proposed to: 1) replace or flank the current second session of the virtual exchange point with a special session for transactions for balancing purposes, to be held for each gas day during the Wednesday of the following week; 2) to introduce a weekly modulating storage service straight away for the thermal year 2009/2010 subject to regulated tariffs and supplied not only by storage operators but also by single storage users who have sufficient availability.

07.27.2009 Elettricità Orientations for dispatching electricity generated from non programmable renewable sources.
The Authority presents its orientations for action  to be taken to improve the management of the grid in the presence of a progressive increase in electricity generated from non programmable renewable sources. The actions proposed can be divided into short, medium and long term. The first are designed to bring the management  of non programmable production units into line with that for programmable units as much as possible. The second are designed to improve actions and tools identified for short term action and to introduce new management instruments, such as a different system for calculating unbalances for non programmable plants, based on an incentive scheme. Finally, long term action consists mainly of implementing grid developments already planned by the transmission grid operator.

07.27.2009 Elettricità Amendments to electricity dispatching regulations: new procedures for the management of consumptions units and determination of actual imbalances.
The Authority proposes the separate valuation of unbalancing due to withdrawal programming errors for hourly treated delivery points and that due to errors in forecasting residual area withdrawals, because of the different tools available in the two cases. The Authority proposes that unbalancing prices apply from 1st January 2010 to the residual amount with respect to a threshold to be set for consumption units with hourly treated withdrawals. For consumption units with hourly treated withdrawal, the Authority  proposes the application of unbalancing prices to the entire physical balance of the actual unbalancing account.

07.27.2009 Elettricità Mechanism to monitor sales to end users of electricity from renewable sources.
The Authority proposes three possible mechanisms for controlling sales of renewable energy to end user customers with the ultimate objective of increasing transparency in the retail electricity market: 1) the use of current systems to label electricity produced form renewable energy resources, but defining general guarantee conditions for end user customers; 2) the creation of a system of negotiable renewable energy certificates; 3) the redistribution of costs incurred for policies to promote renewable energy sources among end user customers.

07.23.2009 Gas Criteria for determining tariffs for the transport and dispatching of natural gas for the third period of regulation.
On completion of the consultation procedures started with Resolution No. ARG/gas 50/08, the Authority publishes final orientations relating to gas transport and dispatching tariffs in the period 2009-2013. The main changes proposed by the regulator include: 1 the possibility of employing a calendar year instead of a thermal year for determining transport tariffs; 2. a proposal to remunerate costs incurred for the purchase of gas required for the functioning of compression plants and the replacement of leakage from pipelines by means of a system of specific incentives instead of price caps; 3. a proposal to treat gas not accounted for with criteria analogous to that required for physical leakage from pipelines, by putting replacement mechanisms in place as part of the balancing service; 4. the possibility of determining system balancing costs according to market criteria in the third regulatory period.

07.23.2009 Elettricità Instruments designed to reduce credit risk for sellers on the electricity market and proposals to amend Resolution No. arg/elt 4/08 with regard to customers that may not be disconnected.
The Authority proposes a series of measures to reduce credit risk borne by sellers on the electricity market in relation to end user customers. The measures consist of the creation of a list of customers in arrears that may be consulted by sales companies, the revision of the security deposit paid when a contract is signed, the development of direct debit bank or credit card payment, the creation of a mutual system among sellers and the use of credit recovery and specialist factoring companies.

07.17.2009 Efficienza energetica Update of technical sheets for the quantification of primary energy savings.
The Authority presents an update of the technical sheets for the quantification of primary energy savings introduced in accordance with Resolution No. 103/03 of 18th September 2003 with reference to the following: a) the installation of compact fluorescent lighting with ballast incorporated in residential premises; b) the new installation of single household gas fuelled four star efficiency rated boilers; c) the use of solar panels for the production of hot water; d) the installation of low flow shower heads in hotels and hostels; e) the installation of low flow shower heads in sports facilities. The deadline for the presentation of comments is 2nd September 2009.

07.17.2009 Elettricità Procedures for performing controls for the provision of incentives for the use of electronic meters for the purposes of identifying low voltage customers involved in electricity service interruptions.
The Authority presents a summary of controls and the relative objectives to verify the use of electronic meters by distributor companies in order to identify low voltage customers involved in electricity service interruptions. The objective of the controls proposed are to ascertain compliance with meter installation and commissioning obligations, to ascertain the number of low voltage withdrawal points and to ascertain whether reports are made and whether records are kept of customers that are misaligned by the use of electronic meters.

07.07.2009 Elettricità Gas Revision of some measures relating to quality standards for telephone services pursuant to code for the quality of the electricity and natural gas sales service.
The Authority has formulated proposals to revise some measures relating to quality standards for telephone services pursuant to the code for the quality of the electricity and natural gas sales service. The proposals concern: 1) revision of the obligation to provide a call centre pursuant to paragraph 21.1, letter d) of the code for the quality of the electricity and gas sales service with reference to sellers with fewer than 5,000 end user customers; 2) revision of the points assigned for the weekly opening of a call centre; 3) the introduction of criteria to identify serious violation of overall quality standards pursuant to paragraph 27.3 of the code for the quality of the electricity and gas sales service.

07.06.2009 Second level analysis criteria and procedures for ascertaining whether increased taxes have been passed on to consumer prices (Art. 81, paragraphs 16 to 18 of Decree Law No. 112/2008).
The Authority has started consultation to formulate monitoring procedures for passing on increases in corporate income tax costs onto prices. The Authority is starting more detail inspections in cases where a company fails fully or partially to respond to requests for information and data and in cases where the first level indicator increases and the reasons given by the operator are inadequate. The Authority proposes to extend the analysis of the operations of individual operators in the context of the group to which the operator belongs and in the context of the supply chain and sector of which it forms part.

07.01.2009 Gas Measures for access to the national gas pipeline network in application of the Ministry of Production Decree of 28th April 2006.
The Authority starts consultation to formulate, in application of Ministry of Production Decree of 28th April 2006, procedures and criteria for access to entry capacity to the national gas mains for operators who are exempt from granting access to third parties (TPA) on newly constructed or expanded infrastructures (natural gas pipeline or regasification terminal). The consultation regards the requirements for access and the type of documentation to be presented, the performance of the open allocation procedures and the criteria for granting capacity.

07.01.2009 Gas Criteria to define and attribute accounting entries for the balancing of natural gas arising from adjustments made to allocation and metering data following the end of the transport accounting period.
The Authority publishes final orientations relating to settlement payments arising following adjustments to allocation and metering data received after the end of the final transport accounting period as at month M+3. The recommendations of the Authority regard solely the valuation of the commodity, by means of a special price index, wrongly attributed to single transport service users. Transport and storage payments and penalties on the other hand are not subject to correction.

06.15.2009 Gas Additions to Resolution No. 119/05 of 21st June 2005 relating to strategic storage.
The Authority proposes an addition to the regulations for strategic storage and its use pursuant to Resolution No. 119/05, in order to include within those cases specified by that resolution also the hypothesis of the use of strategic storage by an operator which has gas available and storage capacity, with which to compensate withdrawals from strategic stocks.

06.15.2009 Gas Compensation systems for costs not otherwise recoverable incurred by sales companies in application of articles 1 and 2 of Resolution No. ARG/gas 192/08.
The Authority advances for consultation its orientations for the identification of systems to compensate costs "not otherwise recoverable" incurred by natural gas sales companies following the removal of the "no-change threshold" of the It index imposed by Resolution No. 192/08. The Authority firstly sets a time limit (15th September 2009) for the obligation to remove any no-change clauses existing in wholesale gas sales contracts. The Authority then proposes criteria for the recognition of various costs depending on the type of sales company or wholesale supplier and seller to end user customers. Finally the Authority advances proposals in relation to the procedures for the recognition of the costs and the methods of paying compensation.

06.12.2009 Elettricità Gas Options to harmonise and increase the transparency of invoice documents for electricity and gas consumption.
As part of the procedures started with Resolution No. ARG/com 148/08, the Authority proposes various alternative settlement options in relation to the harmonisation and transparency of invoice documents for the consumption of electricity and gas distributed through urban networks, with account taken of Resolution No. 42/99 for the gas sector and Resolution No. 152/06 for the electricity sector. In detail, the proposals concern on the one hand final improvements to the consumption summaries and the boxes giving simplified details and on the other hand the standardisation of the structure and contents of the invoice documents for electricity and gas consumption.

06.10.2009 Gas Regulation of the general aspects of the quality of the natural gas transport service.
The Authority issues the final proposals to submit to the attention of operators concerning the regulations for the quality of the natural gas transport service, currently regulated by the various network transport codes approved by the Authority and contained in Resolution No. 185/05. The proposals have been formulated with account taken of the responses of operators in the previous two consultations (documents No. 35/06 and No. 44/07), of the regulations relating to tariffs and access to networks and of the parallel development of tariff regulations for the transport service in the period 2009-2013.

05.07.2009 Gas Provisions relating to the determination of the quantities of gas to be allocated daily by transport companies within the meaning of article 29 of Resolution No. 138/04.
The Authority advances a proposal to operators of a procedure for redefining the quantities of gas allocated on a daily basis by the largest transport company for the purposes of calculating transport, storage and balancing payments. The new calculation procedure involves the redefinition by means of a withdrawal coefficient and a monthly coefficient of the daily profiles calculated by the transport company on the basis of monthly withdrawal data. The daily withdrawals recalculated in this manner will be used for the possible redefinition, solely in favour of users, of the difference payments for storage and withdrawal and the difference payments with respect to the delivery capacity from storage, in the period between 1st October 2007 and the time at which the distribution companies will be required to communicate daily withdrawals by users.

05.07.2009 Elettricità Short term contracts to upgrade electricity generation capacities.
The Authority commences consultation to redefine the remuneration of available electricity generation capacity. After defining the compliance objectives for the generation plants which the grid operator (Terna) must pursue, the Authority proposes the establishment of option contracts between the grid operator and generators to be entered into by means of competitive procedures centred on the premium of the option contract.

04.27.2009 Elettricità Electricity distribution service continuity - urgent re-examination of some measures to regulate the number of service interruptions without advance warning and the changes in levels in the period 2008-2011.
The Authority has commenced consultations to amend the statistical methods which identify "periods of disturbed conditions" in which exceptional interruptions occur attributable to "acts of God". The Authority proposes in this respect changing the statistical methods by excluding 100% of the number of long interruptions that occur in periods of disturbed conditions. Furthermore the Authority proposes amendments to the quality code in relation to prolonged interruptions attributable to thefts of copper in electrical wiring.

04.27.2009 Elettricità Tariff regulation of temporary connections to the medium and low voltage electricity distribution grids.
The Authority commenced consultations for the revision of the terms and conditions for the provision of the connection service (connection service code) and presented some proposals for amending the regulations for temporary connections. The issues subject to consultation concerned: (i) the scope of application of the regulations for temporary connections; (ii) regulations for temporary low voltage connections performed by means of transitory and permanent grids; (iii) the supplement for connection and disconnection operations performed, on request, outside normal working hours; (iv) the regulations for medium voltage temporary connections; (v) limitation of the power drawn and electricity metering; (vi) the impact on the revenues of the distribution companies.

04.17.2009 Efficienza energetica Proposals for new technical sheets for the quantification of energy savings relating to intervention pursuant to article 5, paragraph 1 of the Ministerial Decrees of 20th July 2004.
The Authority starts a consultation process designed to define and revise 7 technical sheets for the quantification of primary energy savings achievable through admissible intervention in accordance with article 5, paragraph 1 of the Ministerial Decrees of 20th July 2004. The Authority also invites those concerned to present proposals for the definition of technical sheets for further intervention which concerns the areas indicated in the consultation document. The time limit for sending in observations is 25th May 2009.

03.31.2009 Gas Criteria for determining tariffs for the transport and dispatching of natural gas for the third period of regulation.
The Authority proposes amendments to the criteria for determining tariffs for the transport and dispatching of gas for the third period of regulation 2009-2012. The main changes concern new investment incentives, different productivity coefficients for different companies and the modification of the distribution between the capacity component and the commodity component. Important changes also concern the remuneration of the metering service and cover for non accounted gas costs and grid leakage.

03.16.2009 Gas Review of methods for handling batches of gas not subject to direct metering as part of the gas balancing service.
In order to determine any imbalances between gas fed into and withdrawn from the grid, the Authority brings to the attention of operators a possible review of the formulation of balance equations of users and of the Transmission System Operator (TSO), with the aim of reducing the level of uncertainty that, due to estimation and metering errors, weighs upon transport users. The proposal envisages the introduction of a parameter known beforehand for attributing part of non-metered batches to each of the users in proportion to the impact of their withdrawals on the overall total. The batches not metered that exceed the total thus attributed to all transport users will be inserted into the balance of the TSO and remunerated according to methods to be defined as soon as possible.

The Authority starts a consultation process for the outline of a provision to define regulations which will apply to procedures for the adoption of regulations or for the general effectiveness of the Authority itself. The time limit for sending in comments and observations is 30th May 2009.

02.04.2009 Gas Criteria to define and attribute accounting entries for the balancing of natural gas arising from adjustments made to allocation and metering data following the end of the transport accounting period.
The Authority observes that there are frequent delays in receiving gas meter readings from transport service users and notes the difficulties that arise for users themselves from the discrepancies between final end of period transport financial reports and the relative payments made three months later and the need to make payments to settle balances following late adjustments to amounts agreed between the parties concerned. The Authority therefore proposes setting up periodic sessions to settle those balances and suggests some possible price indexes for making accounting entries. The deadline for sending in observations is 13th March 2009.

01.08.2009 Elettricità Code for electicity distributor activities.

The Authority starts procedures for the definition of the electricity distribution code containing rules of access and of delivery for the electricity distribution service. In order to perform preparatory activity for the definition of the code, the Authority plans to involve distributor companies, Terna and representatives of wholesalers and consumers. The Authority plans to consult interested parties by asking them for comments on documents as they are produced. The time limit for the presentation of observations on chapters 2 and 3 is 23/01/2009.
