12.29.2008		Amendments to Authority Resolution No. 351/07 of 29th December 2007 for the definition of reward and penalty mechanisms to incentivise the company Terna Spa in the supply of resources for the electricity dispatching service. The Authority introduces remuneration from 1/1/2009 as an incentive to Terna to minimise dispatching costs, based on a reward-penalty system: Terna receives/pays a reward/penalty each year up to a predetermined cap/floor if it reduces/increases the amount of the resources procured on the dispatching services market for dispatching activities, with respect to the historical target quantity, on condition that safety standards are not lowered and instruments to monitor the dispatching services market by the Authority are promoted. 12.29.2008		Approval of the annual programme of controls and inspections for registered sales companies in accordance with Authority for Electricity and Gas Resolution No. 134/07 of 11th June 2007. The Authority has decided to approve the annual programme of controls and inspections for registered sales companies in accordance with Resolution No. 134/07, on the basis of Annex A of this resolution. 12.29.2008		Provisions relating to the tariff contribution to achieve energy savings objectives for 2009 pursuant to the Ministerial Decree of 20th July 2004 as amended and added to by the Ministerial Decree of 21st December 2007. Following the consultation process started with document DCO 32/08, the Authority defines a formula to update the tariff contribution to cover costs incurred by "obliged distributors" as part of the energy efficiency certificates mechanism to implement energy savings projects. The update takes account of the average value of electricity, natural gas and fuel oil for transport. The new formula is applied from 2009 and the Authority has set the tariff for this year at €88.92 per toe. The tariff contribution is extended, starting with the 2008 obligation, to include type III energy efficiency certificates, which are those for primary energy savings other than electricity and gas savings. Finally, the Authority postpones the time limit set by article 3, paragraph 2 of Resolution No. 219/04 until 30th November of each year.	EEN 36/08
12.23.2008		Introduction of a directory for electricity power plants and rationalisation of information flows between the different entities operating in the electricity production sector. In order to rationalise information flows between institutional bodies and entities operating in the electricity sector and to create a single national directory for electricity generation plants by which they can be identified unequivocally, the Authority charges Terna with the task of creating, managing and maintaining a database to be named CENSIMP, which contains all the plants and assigns a unique code name (processed by Terna) to them. The Authority also establishes the obligation for all producers to populate CENSIMP. They shall be responsible for the accuracy and updating of the data, according to times indicated in the implementation plan which Terna must communicate to the Authority by 30/04/09. Finally the Authority establishes that all entities must use the CENSIMP code from 01/01/10, although there may be a transition period.	ARG/elt 205/08
12.23.2008		Provisions concerning the equalisation fund for the electricity sector for the implementation of article 20, paragraph 4, of Law No. 9 of 9th January 1991, as interpreted by article 3-bis of Decree Law No. 162 of 23rd October 2008, converted with amendments into Law No. 201 of 22nd December 2008. In consideration of the special conditions granted to Terni Spa for the supply of electricity until 31/12/07, the Authority mandates the equalisation fund for the electricity sector to recalculate the compensation due to Terni Spa in the period 2002-2007 by means of a specific compensatory component applied to the distributor company and quantified and paid by that fund. The Authority also specifies the criteria which the fund must follow.	ARG/elt 204/08
12.23.2008		Amendments to Authority for Electricity and Gas Resolution No. 111/06 of 9th June 2006, terms and conditions for the provision of the merit order dispatch service for 2009. The Authority establishes new conditions for the dispatching service for 2009. The most significant amendments are as follows: 1) reduction to 1.5% of the threshold for imbalances of consumer units; 2) the adjustment market is opened to the demand and suspension of the bilateral adjustment platform; 3) abolition of additional bids by Terna on the day ahead market; 4) various measures for the promotion of the transparency of dispatching costs; 5) the introduction of the value of electricity not supplied amounting to €3,000 per MWh also on the adjustment market; 6) the introduction of the ITC payment made to Terna to cover transit costs on foreign grids resulting from cross-border trading. 12.23.2008		Fact finding and reporting activity on trends for the supply of electricity and gas to end user customers. The Authority decides the publication on its website by the end of January 2009 of summary data on the development of competition on liberalised electricity and gas markets with particular regard to exits from protected regimes and changes of supplier by end user customers. 12.23.2008		Amendments and additions to Part II of Annex A of Resolution No. 333/07 of 19th December 2007 entitled "Code for the quality of the electricity distribution, metering and sales service for the regulatory period 2008-2011". Having assessed the observations made by operators on the second consultation document prior to the publication of the Code for the quality of the electricity and gas sales service, the Authority decides to amend the regulations for the quality of the electricity distribution, metering and sales services for the regulatory period 2008-2011 with regard to obligations of distributors to suppliers in order to maximise the effectiveness of incentives designed to improve the quality of the electricity sales service. 12.23.2008		Amendments and additions to Resolution No. ARG/gas 120/08 of 7th August 2008 and to the relative Annex entitled "Regulations for the quality of gas distribution and metering services for the regulatory period 2009-2012". Having assessed the observations made by operators on the second consultation document prior to the publication of the Code for the quality of the electricity and gas sales service, the Authority decides to amend Resolution No. ARG/gas 120/08 with regard to obligations of distributors to suppliers in order to maximise the effectiveness of incentives designed to improve the quality of the natural gas sales service. 12.23.2008		Amendments and additions to Annex A of Resolution No. ARG/com 164/08 of 18th November 2008 entitled "Code for the quality of the electricity and gas sales service". Having assessed the observations made by operators and consumer associations on the second consultation document prior to the publication of the Code for the quality of the electricity and gas sales service, the Authority decides to amend the code with regard to supplier obligations concerning replies to complaints made by multi-site customers, different complaints regarding the same matter, single complaints signed by more than one customer and supplier obligations where a reply to a complaint implies the involvement of the distributor. 12.23.2008		Conclusion of the fact-finding investigation started with Authority for Electricity and Gas Resolution No. 238/06 of 6th November 2006 into the causes and dynamics of interruptions to the electricity service occurring in the country on 4th November 2006. The Authority declares the conclusion of the fact-finding investigation started with Resolution No. 238/06, following the widespread faults on the European electricity grid which occurred on 4th November 2006 and which involved the separation of the UCTE grid into three distinct areas. Responsibility for the fault was attributed to two principal causes: failure to observe condition N-1 following the opening of the Conneforde-Diele double line and lack of co-ordination between the different grid operators involved. 12.23.2008		Extension of the time limit for the conclusion of the fact finding investigation started by Authority for Electricity and Gas Resolution No. VIS 68/08 of 22nd July 2008 into possible irregularities in the application of regulations for safeguarded categories in the electricity market. The Authority has decided to extend the date of the conclusion of the fact-finding investigation into possible irregularities in the application of the regulations for safeguarded categories in the electricity market (started with Resolution No. VIS 68/08) from 31st December 2008 until 28th February 2009 in order to acquire further information. 12.22.2008		Extension of the time limit for the conclusion of the procedures pursuant to Resolution No. ARG/gas 118/08 of 6th August 2008 for the approval of tariff proposals for the regassification service for the thermal year 2008-2009 of the company Terminale GNL Adriatico S.r.l.. The time limit for the approval of the tariffs of the company Terminale GNL Adriatico S.r.l. is postponed until 31st March 2009 because further analysis of operating costs is required.	ARG/gas 198/08
12.22.2008		Amendments, additions and corrections of material errors of Part II of "Regulations for gas distribution and metering services tariffs and quality in the gas regulatory period 2009-2012 (Gas Tariff Distribution Regulation)". In addition to correcting some material errors, the resolution defers by six months the time limit for the entry into force of paragraph 53.1 b) of the Gas Tariff Distribution Regulation which establishes responsibility on the part of distributor companies for the acquisition, validation and recording of gas meter readings at the redelivery points. 12.22.2008		Update of the specific company correction factor for revenues admissible for covering distribution costs pursuant to Authority for Electricity and Gas Resolution No. 316/07 of 11th December 2007 for the companies, Acea S.p.A., AEM Elettricità S.p.A., ASM Distribuzione elettricità s.r.l. Azienda Energetica S.p.A., Etschwerke AG, Deval S.p.A., for the years 2005 and 2006 and for the companies Amaie Sanremo S.p.A. and ASSEM Sp.A. of San Severino Marche for the year 2005. The Authority has decided the update of the specific company correction factor for revenues admissible for covering distribution costs for the companies Acea S.p.A., AEM Elettricità S.p.A., ASM Distribuzione elettricità s.r.l. Azienda Energetica S.p.A. Etschwerke AG and Deval S.p.A. for the years 2005 and 2006 and for the companies Amaie Sanremo S.p.A. and ASSEM S.p.A. of San Severino Marche for the year 2005. The Authority performed that update by deciding to adjust the value of the component "s3 (disat); r3 (disat)" for the type "e) other medium voltage users " by the amount of €cent 0,0300 per kWh. 12.19.2008		Update for the first quarter of 2009 (1st January- 31st March) of the table in Annex C of Resolution No. 110/07. The Authority has ordered the update of the table for estimating annual expenses, exclusive of taxes, on the basis of the terms and conditions of the Authority for the first quarter of 2009. 12.19.2008		Update for the quarter January-March 2009 of the tariffs for the supply of gas other than natural gas distributed through urban networks pursuant to Authority for Electricity and Gas Resolution No 52/99 of 22nd April 1999, with subsequent amendments and additions and extension for the quota for retail sales costs. The Authority reduces the tariffs for the supply of liquid petroleum gas for the quarter January 2009 - March 2009 by 3,341 euro/GJ and postpones the subsequent measure to revise the quota representing the retail sales cost for the gas distributed, temporarily maintaining the values applied for the thermal year 2007-2008. 12.19.2008		Urgent measures to amend the criteria for the update of the terms and conditions for the supply of natural gas to protected category customers and update for the quarter January-March 2009. In order to ensure prompt implementation of article 3, paragraph 8, of Decree Law No. 185/08, the resolution renews the no-change threshold starting from the update for the January-March quarter of 2009, imposing that elimination also on all the parties to contracts for the wholesale sale of gas destined to protected category customers and amending the terms and conditions of supply as a consequence. 12.19.2008		Update for the quarter January-March 2009 of the tariff components destined to cover general electricity system costs and of additional components. Introduction of the UC7 tariff component and amendments to Annex A of Authority Resolution No. 348/07 of 29th December 2007. The Authority has updated tariff components destined to cover general electricity system costs for the first quarter of 2009. In detail the Authority has: a) increased the A4 component; b) decreased the UC3 component; c) increased the rate for the As component; d) left the rates for the components A and MCT unchanged; e) introduced a new component, UC7, to cover costs resulting from measures and action to promote energy efficiency in the end uses of electricity. 12.19.2008		Update for the first quarter of 2009 (1st January- 31st March) of the terms and conditions for the sale of electricity to protected categories and amendments to the sales code and the transport code. The Authority has updated the terms and conditions for protected category customers for the first quarter of 2009. Electricity bills have fallen by 5.1% on an annual basis.	ARG/elt 190/08
12.19.2008		Update for 2009 of the payment to cover costs recognised for the operation of Terna and revision of payments pursuant to articles 45, 48 and 73 of Authority Resolution No. 111/06 of 9th June 2006. The resolution updates the payments for dispatching to cover the costs of: remunerating production capacities, the interruptibility service, units essential for safety, the functioning of Terna. 12.19.2008		Update for 2009 of electricity transmission, distribution and metering services tariffs and of terms and conditions for connection services. In addition to the update of the transport code and the connection service code with account taken of the variables in question, in order to strengthen incentives for the introduction of new transmission infrastructures that are strategic to the development of competition, the resolution establishes: the activation of a "reward-penalty" mechanism; the suppression of the fixed quota contribution for requests to change supplier; the adoption of measures designed to limit risks connected with possible strong fluctuations in demand for electricity. 12.18.2008		Provisions concerning the publication by Terna of information on the available capacity of electricity generation units. In accordance with EC regulation No. 1228/2003 which states that TSOs (Transmission system operators) must publish data on cross-border trade, the Authority approves provisions for the publication by Terna of information on the available capacity of electricity generation units starting from 01/02/09 at the latest. More specifically the Authority establishes the timing of publication (up to 7 days following) and the methods of aggregating the data for expected hourly values and for the actual hourly values of production capacitiesof not less than 100 MW. 12.18.2008		Amendments and additions to Authority for Electricity and Gas Resolution ARG/elt 4/08 of 25th January 2008 relating to regulations for the dispatching service and the transmission service (transmission, distribution and metering) in cases of consumers in arrears or non performance by the supplier. The Authority decides amendments to regulations concerning end user customers in arrears with payments (Resolution No. ARG/elt 4/08), with particular regard to transitory measures regarding the suspension of supply for low voltage withdrawal points not equipped with electronic meters in service. 12.18.2008		Approval of the budget forecast for the year 1st January 2009 - 31st December 2009 of the Authority for Electricity and Gas. Having heard the opinion of the Board of Auditors, the Authority approves the budget forecast for the year 1st January 2009 - 31st December 2009, attached to this measure and approves publication in the Official Journal. 12.17.2008		Amendments and additions to the Authority for Electricity and Gas provisions on communication standards between operators in the natural gas sector set by Resolution No. 294/06 of 18th December 2006 and approval of operational instructions for communication standards. The Authority approves amendments and additions to provisions concerning standards for communications between distributors, users of the distribution services and sellers of natural gas. 12.17.2008		Amendments to the personnel organisation chart of the Authority for Electricity and Gas. The Authority approves a new organisation chart for its personnel (Annex A of this resolution) in order to take account of the consolidation of the new organisational structure, of the objectives of the 2008-2010 three year strategic plan and operational plans and of the new and greater duties planned for the Authority by recent legislative measures. 12.16.2008		Transitory provisions relating to on-the-spot electricity trading. The Authority decides a series of rules designed to facilitate the transition to the new regime of on-the-spot trading (Resolution No. 74/08), in force from 1st January 2009. The Authority firstly establishes that operators trading on the basis of the old regime (Resolution No. 28/06) make final settlement payments relating to the application of the old regulations by 31st March 2009. Furthermore, the Authority establishes that the electricity services administrator pays a contribution of 50 euro for each kW of capacity for the plants entering the new regime. This contribution will then be reabsorbed with subsequent accounts and settlement payments established by the electricity services administrator to implement Resolution No. 74/08. Finally, the Authority amends Resolution No. 74/08 establishing that the value of electricity fed into the grid may offset the total cost of energy drawn from it with the exception of VAT, if a consumer has a VAT number. 12.15.2008		Amendments to Resolution No. ARG/elt 78/08, urgent provisions relating to general equalisation for 2007 and provisions concerning the equalisation fund for the electricity sector. The start of procedures pursuant to article 2, paragraph 5 of the joint Ministry of Production and Ministry of the Economy and Finance Decree of 22nd June 2005. The Authority decides to amend the timing relating to equalisation for 2006 and to extend the possibility offered to operators by Resolution No. ARG/elt 78/08 to request payment on account, subject to final settlement, from the equalisation fund, of the equalisation amounts for 2007, limited to the equalisation of the costs of electricity supplies destined to customers in the restricted and protected categories market. 12.15.2008		Imposition of fines in accordance with letter c), paragraph 20, article 2 of Law No. 481 of 14th November 1995 on the company Iride Acqua Gas S.p.A.. The Authority ascertains violation by the company Iride Acqua Gas S.p.A. of obligations designed to guarantee an effective and efficient prompt intervention service, of regulations for the content of estimates for the performance of work to be communicated to customers by distributors and of regulations concerning indemnities to be paid to customers if specific standards of the distribution service are not maintained for causes attributable to the distributor and it imposes an administrative fine for a total amount of 330,000.00 euro. 12.15.2008		Approval of the programme of inspections for operators who have not sent in the documentation required under Resolution No. 91/08 of 4th July 2008 ARG/com. The Authority decides ten inspections of operators who did not file accounting documents with it by 31st July 2008 as required by resolution No. 91/08. The Authority decides that the inspections are to be performed jointly with the Special Market Protection Squad of Guardia di Finanza (tax police) and that they are to ascertain the reasons for the failure to file the documents and to acquire information on accounts pursuant to point 1 of Resolution No. 91/08. 12.15.2008		Determination of specific primary energy savings objectives for 2009 for electricity and natural gas distributors subject to the obligations pursuant to the Ministerial Decrees of 20th July 2004 as amended and added to by the Ministerial Decree of 21st December 2007. After identifying distributors of electricity and gas who in 2007 had more than 50,000 end user customers connected to their networks ("obliged entities" according to regulations governing energy efficiency certificates), the Authority sets specific primary energy savings objectives for each of them on the basis of the share of electricity (gas) distributed with respect to the total electricity (gas) distributed by "obliged entities". 12.12.2008		Provisions for 2009 concerning the management of import and export congestion on the interconnection network with other countries. The Authority approves the rules for access to interconnection networks drawn up by Terna jointly with the grid operators of bordering countries. The Authority also approves the provisions for 2009 relating to import and export congestion on the interconnection network with other countries. Finally, the Authority decides that the purchase price for electricity imported by the Italian holder of the long term import contract on the part of the Single Buyer is to be updated on a quarterly basis. 12.12.2008		Start of official investigations for the imposition of administrative fines relating to prompt intervention for the natural gas distribution service on the companies Enel Rete Gas S.p.a., Compagnia Napoletana di Illuminazione e Scaldamento col Gas S.p.a. and Società Italiana per il gas per Azioni - Italgas. The Authority starts an official investigation into the companies Enel Rete Gas S.p.a., Compagnia Napoletana di Illuminazione e Scaldamento col Gas S.p.a. and Società Italiana per il gas per Azioni - Italgas for suspected violations in 2007 of the obligation to provide a prompt intervention service and to impose administrative fines. 12.11.2008		Determination of terms and conditions for the supply of gas other than natural gas for the companies COLSAM SRL and SAC PETROLI SAS for the thermal years running from 2001/2002 to 2007/2008 following procedures started with Resolution No. VIS 45/08 of 27th May 2008. The Authority determines and applies terms and conditions for the supply of gas other than natural gas for the companies COLSAM S.p.A. and SAC PETROLI S.a.s. for the thermal years running from 2001/2002 to 2007/2008. Those conditions of supply are contained in two tables attached to this resolution.	ARG/gas 181/08
12.11.2008		Extension of the validly of the agreement for the supply of resources by Terna for the dispatching service for the continuity of electricity supplies in the geographical area served by the company Idroelettrica Valcanale S.a.s.. The Authority extends until 31/12/2011 the expiry date of the agreement between Terna and Valcanale for the supply of dispatching services essential for the continuity of the service in the municipality of Tarvisio, until the interconnection between Tarvisio-Kelag already authorised is implemented. The resulting costs are included in the uplift.	ARG/elt 180/08
12.11.2008		Amendments and additions to Authority for Electricity and Gas resolutions No. ARG/elt 99/08 and No. 281/05 relating to terms and conditions for grid connection with the obligation to connect third party electricity generation plants. The Authority decides a series of amendments and additions to Resolution No. 99/08 (code for active connections), following reports and study concerning the regulations for connections of electricity generation plants to electricity grids with the obligation to connect third parties established by that resolution. The principal additions include the simplification of connection requests for plants located in the same area. Other important additions and amendments focus on aspects relating to connection service costs. In addition to the code, the Authority amends Resolution No. 281/05 in order to implement a ruling of the TAR (Regional Administrative Tribunal) of Lombardy concerning the attribution of connection costs in the case of the implementation of works which constitute minimum technical solutions potentially appropriate to benefit third parties. Finally, companies which distribute to more than 100,000 customers are obliged to report information on the rate of increase in connection requests in the first period of the implementation of the new code to the Authority. 12.11.2008		Criteria and procedures for verifying compliance with the ban on passing on the increased tax imposed by article 81, paragraph 18, of Decree-Law No. 112 of 25th June 2008, converted with amendments into Law No. 133 of 6th August 2008. The Authority decides the procedures for verifying compliance with the ban on passing on the increased tax imposed on energy companies. The Authority decides that companies must file annual financial statements with the Authority within 30 days of their approval. Companies must also compile and file on a half yearly basis, tables furnished by the Authority with data on revenues and expenses relating to raw materials with the Authority within 60 days. 12.11.2008		Regulations for the organisation and functioning of the Authority for Electricity and Gas. The Authority updates the regulations for its organisation and functioning with particular reference to a more adequate and ordered preparation of the meetings of the Authority itself. The new regulations are contained in the Annex to this resolution. The previous regulations for its organisation and functioning are repealed.	GOP 57/08
12.11.2008		Approval of the state of progress on the 2008 annual plan to implement the Ministry for Economic Development- CESI Ricerca S.p.A. programme agreement and payment of the relative contribution quota to CESI Ricerca S.p.A.. The Authority approves the outcomes of verifications of the interim results achieved with the projects of the annual plan to implement the programme agreement between the Ministry for Economic Development and CESI Ricerca S.p.A. for the year 2009. The total cost of the activities of those projects to 31st August 2008 amounted to 15,029,490 euro. A reimbursement of 10,520,643 euro is recognised as payable to CESI Ricerca net of the amount already paid on account.	RDS 10/08
12.10.2008		Measures relating to the treatment of electricity fed into the grid. The Authority approves a series of provisions relating to the treatment of electricity fed into the grid designed to ensure proper functioning of the dedicated withdrawal systems and on-the-spot trading. The regulations concern the feed-in of electricity through feed-in points where electricity is only withdrawn for ancillary generation services and also through connection points where withdrawals are destined to supply end user customers. In addition to those measures, the Authority establishes transitory measures for 2009 for the metering of electricity fed into the grid with regard to the on-the-spot trading system and the relative treatment for dispatching purposes. Finally the Authority amends the load profiling code to take account of the new procedures for treating electricity fed-in for the purposes of calculating the "area residual withdrawal". 12.10.2008		Definition of times in accordance with Title II, point 7 bis, of CIP measure No. 6/92 for the recognition of costs resulting from the application of EC Directive No. 2003/87/EC for the second period of assignment. The Authority makes additions to the text of Resolution No. ARG/elt 77/08, relating to conditions for costs incurred in application of Directive 2003/87/EC by plants operating in CIP 6 regime. The additions concern the timing for the recognition of those costs: the Authority establishes that the recognition of costs is performed between 1st October and 31st December of each year in cases in which the information required for recognition is sent in to the Authority by 31st October, while in other cases recognition occurs within 60 days of the date of receipt of that information. 12.10.2008		Measures relating to the first period of application of Authority for Electricity and Gas Resolution No. 280/07 of 6th November 2007, relating to the dedicated withdrawal of electricity. The Authority establishes that the cost quota of imbalance payments (approximately 1.8 million euro) relating to programming of electricity feed into the grid by the electricity services administrator for plants admitted to the dedicated withdrawal regime (Resolution No. 280/07) in the period between 1st January 2008 and 31st May 2008, are to be borne by the "Account for new renewable energy and similar plants ". That quota will therefore not be borne by electricity generators who have opted for the dedicated withdrawal regime, except from 1st June 2008 onwards.	ARG/elt 176/08
12.10.2008		Update for the year 2008 of the natural gas transport price component, included in the standard average fuel price, for the determination of the fuel cost avoided pursuant to Title II, point 2 of the Interministerial Price Committee Measure No. 6/92 of 29th April 1992 The Authority confirms the value for 2008 of the natural gas transport price component for the calculation of the fuel cost avoided in accordance with the provisions of. CIP6/92, as established in advance with Resolution No. ARG/elt 49/08. That value, calculated for the plants referred to by the CIP6/92 provision, therefore remains at €1.78 c/cu. m.	ARG/elt 175/08
12.10.2008		Amendments and additions to Resolution No. ARG/elt 42/08 of 28th March 2008 and amendments to the sales code. The Authority makes amendments and additions to switching regulations (Resolution No. ARG/elt 42/08). In detail: a) the final deadline for the presentation of switching requests is modified to allow full compatibility of that timing with the exercise of the right to revoke a switching request; b) additions are made to switching requests for a new or previously deactivated withdrawal point, if the identification POD (point of delivery) code which identifies the withdrawal point is not available. 12.02.2008		Adoption of "Regulations for public works, services and supply contracts stipulated by the Authority for Electricity and Gas". 11.27.2008		Amendments and additions to Authority for Electricity and Gas Resolution No. ARG/elt/117/08 of 6th August 2008 relating to methods of applying the expenditure compensation regime for the supply of electricity paid for by domestic consumers suffering hardship pursuant to the Interministerial Decree of 28th December 2007. The Authority has decided to make amendments and clarifications for the system of compensation for expenses incurred by domestic consumers suffering hardship (Resolution No. ARG/elt 117/08). In detail the resolution: a) refines the methods for verifying, by qualified personnel, the validity of applications for admission to the compensation regime; b) provides for exchange of information between distributor and seller companies in addition to those required by Resolution No. ARG/elt 117/08 in order to provide greater information to domestic end users if they are not admitted to the compensation regime; c) standardises the content of applications for admission to the compensation regime and the "self certification"; d) defines the minimum content of the local health authority certifications. 11.27.2008		Definition for 2009 of the gradual introduction of payments by bands applied to electricity drawn from low voltage withdrawal points other than public lighting points, not treated by single hourly bands and provided to protected categories or the free market The Authority has decided to introduce a new payment for the dispatching service (termed GF) for the year 2009 consisting of a negative unit amount in the hourly band F1 and of two positive unit amounts in the hourly bands F2 and F3. The payment GF applies to all low voltage withdrawal points which serve the free market or protected categories which are treated hourly or by bands in accordance with the load profiling code (Resolution No. 278/07). This payment has been decided to ensure graduality in the introduction of sales prices that are different for different hourly bands for low voltage non domestic customers other than public lighting customers. 11.27.2008		Extension of the time limits for switching in accordance with Resolution No. ARG/elt 42/08 of 28th March 2008. The Authority extends until 15th December 2008, the time limit for the presentation of switching requests in accordance with article 3, paragraph 3, letter a) of Resolution No. ARG/elt 42/08, relating to requests which will take effect from January 2009. The term switching is intended as meaning cases one dispatching user taking the place of another on the same active withdrawal point or the assignment of a dispatching user to a new or previously deactivated point. The Authority decides to ask the company SIPPIC S.p.A. to furnish information on the electricity generated and supplied in the years 2006-2008, on the costs incurred for the supply of fuel in those same years and on the cash flow and asset and liability position of that company in order to perform the addition to tariffs recognised to it for the years 2003, 2004, 2005 and 2006. 11.26.2008		Start of a fact finding investigation and of the consequent procedures for determining the conditions for the supply of gas other than natural gas in the geographical area of Toffia (RI) served by the company SILCA SRL for the thermal years running from 2001/2002 to 2007/2008. The Authority starts procedures designed to ascertain in which geographical areas and under what tariff conditions the company Silca S.r.l. supplied gas other than natural gas in violation of obligations to communicate its tariff proposal and to set tariffs for the supply of gas other than natural gas in those geographical areas for the period running from the thermal year 2001/2002 to the thermal year 2007/2008. 11.25.2008		Determination of starting and target levels of continuity for the electricity transmission service for the company Terna S.p.A. for the 2008-2011 regulatory period, in accordance with article 7 of Annex A of Resolution No. 341/07 of 27th December 2007. The Authority sets the starting and target levels for the continuity of the electricity transmission grid service provided by Terna Spa for the 2008-2011 regulatory period in accordance with Resolution No. ARG/elt 341/07. At the same time the Authority amends Annex A of that resolution, by adopting rounding to the third decimal point for the indicator "Number of supply interruptions to the RTN", in order to identify the trend requested more clearly. 11.25.2008		Determination of starting and future levels of continuity for the distribution of electricity service for each geographical area and each year in the 2008-2011 period of regulation in accordance with article 21 of the quality code for the regulation of electricity services approved by Resolution No. 333/07 of 19th December 2007. On the basis of data communicated to distribution companies, the Authority sets the starting and future levels for each year in the current regulation period to assess performance and any incentives there may be for improvements to the continuity of the distribution services in the various geographical zones. For some companies subject to incentive regulations, the determination of levels has been postponed in order to allow data collection or investigations currently in progress to be completed. 11.25.2008		Imposition of a fine in accordance with letter c), paragraph 20, article 2 of Law No. 481 of 14th November 1995 on the company Azienda Consorziale Servizi Municipalizzati S.p.A. for violation of electricity distribution service continuity regulations. The Authority concludes the official investigation started with Resolution No. VIS 31/08 into the company Azienda Consorziale Servizi Municipalizzati S.p.A., having ascertained violation of paragraphs 2 and 3 of article 4 of Resolution No. 4/04, and imposes an administrative fine of 25,822.84. euro. These violations, relating to obligations for the proper recording of service interruptions for the year 2006, emerged from an inspection performed on that company on 18th and 19th September 2007. 11.25.2008		Imposition of a fine in accordance with letter c), paragraph 20, article 2 of Law No. 481 of 14th November 1995 on the company Servizi Valdisotto S.p.A. for violation of electricity distribution service continuity regulations. The Authority concludes the official investigation started with Resolution No. VIS 32/08 into the company Servizi Valdisotto S.p.A, having ascertained violation of articles. 4, 7, 15 and 16 of Resolution No. 4/04, and imposes an administrative fine of 51,000.00 euro. These violations, relating to obligations for the proper recording, processing and communication of service continuity data for the year 2006, emerged from an inspection performed on that company on 2nd and 3rd October 2007. 11.20.2008		Communication obligations on the part of sellers of electricity to end users. The Authority has established the obligation for sellers of electricity to end users, to inform them within 45 days of the end of each quarter, of data concerning the average monthly prices on the end consumer market. These data must be disaggregated on the basis of the characteristics of the market in question, the type of customer served, the voltage level and the price components. For the first time application, sellers must communicate data for the period 1st January-September 2008 by 30th January 2009.	ARG/elt 167/08
11.20.2008		Determination of the constraint on the distribution revenues of the company Sadori rete S.r.l.. The Authority rejects the request for a new determination of the constraint on distribution revenues and for tariff modifications advanced by the company Sadori rete S.r.l. 11.18.2008		Determination of recoveries of continuity for the electricity distribution service for 2007. The Authority determines the total incentives and penalties for 2007 for all geographical areas for which the Authority has defined the year-on-year level of continuity for 2007. More specifically it publishes the values of indicators for precision, appropriateness and recording system resulting from the inspections performed (Resolution No. VIS 43/08), as indicated in Table 1. It also mandates the equalisation fund for the electricity sector to make incentive payments taking account of revenue forecasts for the UC6 tariff component.	ARG/elt 165/08
11.18.2008		The code for the quality of the electricity and natural gas sales service. The new code combines the provisions relating to specific and general quality standards required of sellers of both gas and electricity into a single code. In detail the code: 1) sets the minimum level required for different categories of sales service quality indicators; 2) establishes parameters for assessing telephone services provided to end user customers; 3) sets the level of automatic indemnities due to end user customers if specific quality standards are not satisfied; 4) establishes that failure to comply with general quality standards may give rise to penalties; 5) fully describes the procedure for verifying information provided by companies to the regulator. 11.18.2008		The start of procedures to formulate measures concerning the regulation of electricity grids in the possession of entities obliged to connect third parties which do not hold transmission and distribution concessions and of plants which perform distribution activity in the possession of entities not obliged to connect third parties. The Authority starts procedures for the adoption of measures contained in article 2, paragraph 12, letter h of Law No. 481/95 concerning the definition of quality standards to be guaranteed to users by entities obliged to connect third parties that do not hold transmission and distribution concessions and by plants that perform distribution activity in the possession of entities not obliged to connect third parties. 11.18.2008		Directives to distribution companies concerning disclosures regarding the directory of electricity withdrawal points (amendment to Authority for Electricity and Gas Resolution No 111/06 of 9th June 2006). The Authority amends Resolution No. 111/06 with the objective of defining the minimum contents, the nomenclature and the procedures for communicating directory information, designed to guarantee ordered and full transfer of information essential for performing user dispatching withdrawal activities. The Authority resolves that the same requirements in terms of the minimum size of energy efficiency projects set for distributors already ‘obliged' previously to comply under the extension of the scheme apply to new distributors who are ‘obliged' with regard to the energy efficiency certificates and to those falling within the meaning of article 19, paragraph 1, of Law No. 10/91. 11.17.2008		Amendment to Authority for Electricity and Gas Resolution No. 90/07 of 13th April 2007, relating to incentives for the production of electricity from photovoltaic plants. The Authority adds to Resolution No. 90/07 to implement the Ministry for Economic Development Decree of 19th February 2007, in order to manage the provision of incentives to photovoltaic plants connected to the grid with the obligation to connect third parties by means of a single connection point which are organised in sections characterised by different times of entry into operation and/or by different types of architectural integration. 11.17.2008		Start of official investigations for the imposition of administrative fines into Sarlux S.r.l. and S.E.F. S.r.l. for failure to comply with the obligation to purchase green certificates in accordance with article 11 of Legislative Decree No. 79 of 16th March 1999. The Authority starts an official investigation into the companies Sarlux and SEF for failure to comply with the obligation to surrender green certificates in the years running from 2002 to 2007. The failure to comply relates to three combined heat and power production plants for which cogeneration status was not recognised from 2002 in accordance with Resolution No. 42/02. 11.17.2008		Start of official investigation for the imposition of administrative fines into the company Astea S.p.A. relating to the continuity of the electricity distribution service. The Authority starts an official investigation into Astea S.p.A. to ascertain suspected violations of articles 4, 6, 7 and 11 of Resolution No. 4/04, concerning continuity data for the electricity distribution services, and to impose administrative fines. 11.17.2008		Start of official investigation for the imposition of administrative fines for violations of the standard network code for the distribution of natural gas and/or of Authority for Electricity and Gas resolutions relating to last resort supply by the companies Arcalgas Progetti S.p.A. and Fucino Gas S.r.l.. The Authority starts an official investigation into the company Arcalgas Progetti S.p.A. and Fucino Gas S.r.l. for suspected violation of provisions of the standard network code for the distribution of natural gas relating to the termination of a contract between a distributor and a supplier and/or regulations concerning the proper activation of the procedure for last resort supply. 11.17.2008		Imposition of fines in accordance with letter c), paragraph 20, article 2 of Law No. 481 of 14th November 1995 on the company Salso Servizi S.p.A.. Having completed its investigation and examined the arguments advanced by Salso Servizi S.p.A., the Authority decides to impose an administrative fine of 221.645,68 euro on that company for ascertained violation of obligations relating to the quality of the gas service. 11.17.2008		Imposition of fines in accordance with letter c), paragraph 20, article 2 of Law No. 481 of 14th November 1995 on the company Termoirpinia Energia S.r.l. for violations of natural gas distribution service tariff regulations. The Authority imposes administrative fines for a total amount of 77,468.52 euro on the company Termoirpinia Energia S.r.l. for repeated violations of natural gas distribution service tariff regulations designed to ensure fair competition and to protect consumers. 11.12.2008		Provisions relating to the contribution to contain consumption of natural gas in accordance with Ministry for Economic Development decrees of 11th September 2007 and 30th October 2008. In implementation of the Ministry for Economic Development Decree of 30th October 2008, the Authority defines payments applied to end users for the contribution to containment of gas consumption, bonuses and penalties linked to participation or failure to participate by end consumers in containment in consumption schemes, payments to gas seller companies for the management and promotion of containment of consumption schemes and procedures for rescission of participation in gas consumption containment schemes. 11.06.2008		Quality and tariff code for gas distribution and metering services for the regulatory period 2009-2012 (gas distribution code): approval of part II of "Regulations for gas distribution and metering services tariffs in the gas regulatory period 2009-2012 (Gas Tariff Distribution Regulation)". Transitory measures for 2009. The Authority approves the new tariff rules for gas distribution and metering services, to be applied in the period 2009-2012. The measure is designed to rationalise the system with the end objective of encouraging the development of competition between sellers to protect end users. From the viewpoint of system regulation, the measure defines criteria to: 1) allocate costs and plant costs in particular, in order to bring them into line with the new concessions and to provide certain information on the recognised value of networks and on remuneration of them: 2) to unequivocally identify those responsible for the metering service and the relevant values for economic transactions regarding the natural gas supply service; 3) identification of precise responsibilities concerning sections of the network that are particularly critical from the viewpoint of safety/security. From a strictly tariff viewpoint, the measure defines new criteria for: 1) drastically reducing the number of tariffs present throughout the country by identifying six tariff areas only in which the same tariff is applied; 2) defining a programme for the recovery of management costs inefficiencies both by imposing a gradual reduction of these costs towards greater levels of efficiency at national level and by defining incentive mechanisms for aggregations of small to medium-sized enterprises; 3) more precise assessment of the proportion of public and private sector contributions subtracted from the capital invested and of the consequent remuneration recognised in the tariff; 4) incentives for some investments related to network security/safety. 11.04.2008		Approval of a proposal for amendments to the network code made by the company Snam Rete Gas S.p.A. in accordance with Resolution No. ARG/gas 92/08. The network code of Snam Rete Gas (Chapter 5) has been amended to take account of the new provisions of Resolution No. ARG/gas 92/08, according to which from the thermal year 2007 - 2008, the transport company must make a continuous transport service available with the adjustment of the CPu (unit outlet payment) adjusted proportionately on a monthly basis at outlet points interconnected with LNG terminals until the beginning of the start-up period. The Authority starts official investigations into three companies subject to the obligation to purchase green certificates established in article 11 of Legislative Decree No. 79/99, which did not comply with this obligation for the year 2007. 10.23.2008		Operating procedure for recognition, in accordance with Authority for Electricity and Gas Resolution No. ARG/elt 77/08 11th June 2008, of costs incurred for the implementation of EC Directive No. 2003/87/EC. The Authority defines the operating procedures for the recognition of costs incurred in application of Directive 2003/87/EC (EU emission trading scheme) by plants operating in CIP 6 regime and quantifies the amount recognised for the emission allowances for each of the years in the period 2005-2007. That amount is €21.1 per ton of CO2 for 2005, €17.27 per ton of CO2 for 2006 and €0.78 per ton of CO2 for 2007.	n. /08
10.22.2008		Instructions for the obligatory commissioning of gas metering units meeting minimum functional requirements and having remote reading and remote management functions, for all redelivery points on natural gas distribution networks The Authority introduced smart metering in the natural gas sector. Smart meters shall fulfil minimum functional requirements, be installed on all redelivery points of all natural gas distribution networks (around 300 in Italy, serving 99.9% of the customers) and commissioned in the coming years with graduality, starting from smart meters with higher hourly flow (m3/h) downward to smart meters for mass market". The Authority confirms that the fuel cost avoided component of the CIP6 tariff is determined for 2008 according to procedures contained in Resolution No. 249/06, with the following amendments: 1) the standard component for the value of natural gas is calculated by increasing the frequency of updates from quarterly to monthly; 2) the It index contained in Resolution No. 249/06 is determined on the basis of the monthly averages of the prices of a basket of products in the period between the ninth and the last month prior to the update; 3) the no-change threshold is eliminated. The Authority has approved the regulations for participation in the search engine system for the price quotations of firms that sell electricity and gas. 10.16.2008		Further measures relating to metering of electricity generated by power plants and to metering of electricity generated and distributed by CIP No. 6/92 plants. The Authority amends Resolution No. 88/07 relating to metering of electricity generated in order for that resolution to also apply to plants that entered into service before 13th April 2007 and that, in the case of CIP6 plants with an output of greater than 20 kW, the generators are entitled to the services of the Electricity Services Administrator (GSE) free of charge for the installation and maintenance of the metering equipment. Furthermore the Authority requires grid operators to communicate measurements of electricity supplied to the grid by CIP6 plants to the Electricity Services Administrator in accordance with Resolution No. 280/07 and for grid operators to employ the same procedures to communicate measurements of electricity withdrawn to the Electricity Services Administrator, when requested by the latter. The Authority introduces a series of amendments to the regulations formulated by the Single Buyer to regulate competitive procedures to select safeguarded category service suppliers in the period 1st January 2009 - 31st December 2010. More specifically, distributor companies are required to set an amount for guarantees in relation to safeguarded category transport service supplier contracts and the Single Buyer is required to verify that each safeguarded category supplier has a dispatching contract and one or more transport contracts as from 1st January subsequent to performing competition selection procedures. The Authority amends Resolution No. 42/02 in order to allow it to be applied to cogeneration plants powered by renewable energy sources. 10.02.2008		Guidelines on the application of criteria for the quantification of administrative fines imposed by the Authority for Electricity and Gas in accordance with article 2, paragraph 20, letter c) of Law No. 481 of 14th November 1995. The Authority adopts guidelines for the application of criteria for the quantification of administrative fines with the final objective of increasing the transparency and consistency of its decisions. The principles established by the guidelines include those of them being in proportion to the economic circumstances of the entity fined and of having a dissuasive effect on the recipient and on other operators in general. More specifically, fines may not exceed 10% of the sales turnover of the entity fined. Furthermore, the guidelines state that the Authority must take account of any initiatives that may have been taken by the entity fined which appear concretely designed to improve the conditions of regulated markets or to pursue the interests of the Authority itself more effectively. 08.07.2008		Quality and tariff code for the gas distribution and metering services for the regulatory period 2009-2012 (gas distribution code): approval of part 1 "Regulations for the quality of gas distribution and metering services in the gas regulatory period 2009-2012 (RQDG)". The quality code for gas distribution and metering services establishes a new mechanism of penalties and incentives which will come into operation in 2010. Starting from that year and by 2012, companies with more than 50,000 customers must reduce the number of leaks per thousand customers reported by third parties on their pipelines by approximately 20% per year (on average at national level). A greater improvement in safety parameters of up to 7% per year is required of provinces in which the most leaks are currently recorded. Incentives are also planned for inspections of the level of odorisation. A maximum response time of at least 120 seconds is required for intervention in at least 90% of the requests for intervention. With regard to commercial quality, the new regulations on appointments agreed with customers and indemnities which increase in relation to the delay in execution is extended to the gas sector in a context of convergence between electricity and gas sectors. Furthermore from 2010 onwards all appointments made with end user customers will be subject to an automatic indemnity if unpunctuality exceeds two hours.	ARG/gas 120/08

The Authority approves the tariff proposals for the regasification service for the thermal year 2008-2009 for the company Terminale Gnl Adriatico, subject to further verification to be concluded by 31st October 2008, and it sets the regasification tariff for the company Gnl Italia. 08.06.2008		Procedures for applying the expenditure compensation regime for the supply of electricity paid for by disadvantaged domestic customers pursuant to the Interministerial Decree of 28th December 2007. The Authority commences implementation of the procedures for the application of a new social protection regime by operators which will provide savings of approximately 20% on the electricity bills of domestic customers suffering economic hardship. The amount of this "social bonus" will depend on the size of the family unit (60 euro per year for a family unit of 1-2 persons, 78 euro per year for 3-4 persons, 135 euro per year for units of more than 4 persons). When fully phased in, it is estimated that approximately five million disadvantaged customers may benefit from this social compensation, to which a total of approximately 384 million euro per year will allocated. At the same time as this social protection regime is introduced the Authority has in fact revised the tariff structure applied to domestic customers in general with Resolution No. ARG/elt 117/08. The Authority declares that all disclosure obligations for providers of services to safeguarded and protected categories are regulated by the sales code (Resolution No. 156/07). Additionally, it changes the time limit for the obligation to report to the single buyer for the purposes of monitoring the provision of services to protected categories to ensure that the ability to make adjustments is limited to information relating to the month in which the report is made and the month immediately before it. The Authority partially approves the Terna proposal for the revision of geographical zones for the period 2009-2011. 08.04.2008		Provisions relating to terms and conditions for sales on the regulated market of capacities and quotas of natural gas from gas deposits due to the State in accordance with the Decree of the Ministry for Economic Development of 12th July 2007 and quotas of imported natural gas in accordance with the Decree of the Ministry for Economic Development of 19th March 2008. The Authority defines the criteria for sale to the virtual exchange point of quotas of national production and quotas of imports from non EU countries due to the government. The indications furnished concern the definition of batches, the criteria for the sale and the timing of the procedures cited, along with disclosure obligations for importers or the holders of concessions for the exploitation of deposits. 08.04.2008		Urgent provisions relating to concessions at points of entry to the national gas mains for pipelines connected to regasification terminals and additions to the Authority for Electricity and Gas Resolution No. 137/02 of 17th July 2002. The Authority approves the "preliminary agreement between the Consob (stock exchange authority) and the Authority", which, in accordance with article 66 of the Consolidated Finance Act, regulates the co-ordination of supervisory functions for trading in electricity and gas derivative instruments on regulated markets. The agreement defines the duties of the two authorities in relation to regulatory, inspection and disclosure supervision and it creates a technical committee composed of members of the Authority and of the Consob for study and information exchange purposes. As an exception to Resolution No. 168/06 (which defines the procedures with which transport companies make available and grant transport capacity for access to the national gas mains from importation infrastructures which have obtained exemption from TPA) the time period and the date for making transport capacity available at the incoming point of connection with the Adriatic LNG terminal may be changed by the parties concerned to quarterly instead of half yearly and the final date may be set three months in advance instead of six months. 07.07.2008		Criteria for setting tariffs for the regasification services and amendments to resolutions No. 166/05 and No 11/07. The Authority defines the criteria for setting tariffs for the regasification service for the third period of regulation (1st October 2008 - 30th September 2012). The measure confirms both the revalued historical cost method for the measurement of net invested capital (RAB) and the rate for the remuneration of net invested capital at 7.6% in real terms before tax, along with the criteria for the annual update of revenues and tariffs, except for amortisation which will be updated each year and excluded from the price cap mechanism. The recovery of productivity is set at 0.5% per year in real terms for existing terminals, while it is set at zero for new terminals. The measure also defines a definition of the constraint on revenues which brings the commodity component relative to the regasification capacity up from 80% to 90% and the capacity component relative to the volumes actually regasified down from 20% to 10%. The following remain the same as in the preceding period of regulation: 1) remuneration for new investments, with increases in the rate of remuneration (WACC) up to a maximum of 3% on the basis of 3 different types for a life of 16 years; 2) the guarantee factor to ensure partial cover for revenues relating to capacity commitments if the full terminal capacity is not granted. 07.07.2008		Redetermination of specific primary energy savings objectives for natural gas distributors in 2008 (amendment to Resolution No. EEN 1/08 of 26th February 2008). The provision amends Resolution No. EEN 1/08 on specific primary energy savings and redetermines the total quantity of gas distributed in 2006 in the country by those subject to the measure and also the energy savings targets for 2008 for those subject to the measure. The redefinition of the targets became necessary because of the delay in the communication of the number of end user customers connected to the distribution network by one of the companies subject to the measure. 07.07.2008		Instructions to the equalisation fund for the electricity sector concerning a tariff contribution for achieving energy savings objectives for 2007, in accordance with Resolution No. 219/04 of 16th December 2004. The Authority grants a mandate to the equalisation fund for the electricity sector to pay tariff contributions to those required, to cover costs incurred by them for meeting energy savings targets in 2007. The amount of the contribution to be paid to each recipient is set forth in table 1 attached to the provision. 07.04.2008		Urgent measures for enforcing observance of the prohibition on passing on higher taxation to consumers pursuant to Art. 81, paragraph 18, of Decree-Law No. 112 of 25th June 2008. In compliance with Decree Law No. 112/08, the Authority requests companies subject to the increased taxation required by the law mentioned, to send in accounting documents needed to verify whether the taxation has been passed on to end users. 07.01.2008		Definition of action to take following the conclusion of the renegotiation of contracts for wholesale purchase of natural gas in accordance with the Authority for Electricity and Gas Resolution No. 79/07 of 29th March 2007. The measure defines the procedures for settlement payments for end user customers, made necessary by the application of the terms and conditions for supply defined in Resolution No. 79/07. These settlement payments, defined in paragraph 1.10 of Resolution No. 79/07, are linked to the recovery of costs by retail distributors for the renegotiation of terms and conditions in contracts for the purchase of natural gas, with account taken of sums which may have been paid in accordance with resolutions No. 65/06, No. 134/06, No. 205/06 and No. 320/06. 06.27.2008		Terms and conditions for the supply of natural gas to protected category customers: update for the quarter July-September 2008. Measures concerning the basic provisions to cover costs resulting from activities performed by suppliers. The quarterly update of the terms and conditions for the supply of gas (Resolution No. 138/03) brings the price of gas to 75.70 euro cents/cu. m. (inclusive of taxes). For a family with annual consumption of 1,400 cubic metres, this amounts to an increase of 4.7%, with an increase in annual expenditure of approximately 48 euro. Therefore the average expense for a typical family is approximately 1,060 euro per annum, divided as follows: 1) 416 euro approx. for gas as a raw material; 2) 256 euro approx, for distribution, transport, storage, sales, metering and marketing costs; 3) 388 euro approx, for taxes. Furthermore, companies which sell natural gas on the retail market pay sums for the application of the "last instance wholesale suppliers" variable unit payment (Resolution ARG/gas No. 39/08) to the special fund formed as part of the Electricity Equalisation Fund, defined as the fund for last instance wholesale suppliers, within 60 days of the end of each two month period. The Authority amends and adds to Resolution No. 113/06 which regulates the recognition of costs incurred by CIP 6 plants for observance of the obligation to deliver green cards pursuant to article 11 of Legislative Decree No. 79/99. Electricity distributors may ask the equalisation fund for the electricity sector to pay, for the year 2006, equalisation amounts on account on the basis of the data already communicated to the fund. Finally, the time limits for the verification of constraints on V1 distribution revenues for the year 2007 are postponed and the time limits for the general equalisation for that year are suspended. Recognition concerns the difference, if positive, between the number of quotas yielded and the number assigned. That difference is calculated for each calendar year in the first period as the average price of the EU allowances on the main organised European markets. 06.10.2008		The start of procedures to lay down measures concerning the criteria for the treatment of any settlement balances arising from allocation and/or metering differences for the purposes of gas system balancing. In parallel to the consultation to create a centralised trading and balancing market for natural gas, the Authority starts procedures to define criteria for the treatment of settlement balances that may arise from the balancing services resulting from allocation differences and/or metering differences with respect to the months prior to the time window within which transport operators consider the balances for the transport network as still being temporary. An integral part of that analysis consists of cases of possible instances of the late availability of metering data due to both the periodical nature of measuring the data and to adjustments to data previously used for balancing purposes. The aim is to identify possible impacts on quantities and accounting periods of amounts of gas involved in balancing settlements that subsequently arise. The final objective of the Authority is to identify a single criterion applicable throughout the country which will guarantee certainty and transparency to the sector and contain the relative overall operating costs. These procedures should be completed by the first half of 2009 in order to allow application in the subsequent thermal year. The procedures with be subjected to regulatory impact analysis. The new changes to the final content of the text with respect to the initial recommendations put forward by the Authority concern the economic terms for the service: it will not concern electricity withdrawals which will continue to be regulated by the sales firms; furthermore a contribution is introduced to guarantee that service users receive an equivalence between what they pay for power withdrawn and the value of the power which is fed into the grid. The Authority approves the open season procedures defined by the decree of 21st June 2007, designed to assign increased transport capacity to third parties on the basis of the proposal advanced by the companies Edison S.p.A. and Depa S.A., amounting to approximately 1 Gcu. m./annum to be assigned in 10 capacity batches, defined on the basis of the technical specifications of the Poseidon natural gas pipeline and taking account of the current Greek gas market. 05.28.2008		Start of procedures for compliance with the ruling of the Regional Administrative Court of Lombardy No. 1319/08 of 6th May 2008. 1319/08. Procedures are started for compliance with the ruling of the Regional Administrative Court of Lombardy No. 1319/08 of 6th May 2008 to redetermine the value of the cost component, termed "recognised operating costs", of the constraint on revenues for the thermal year 2003-2004 relating to the locality of Conegliano. In order to achieve this, it will be necessary to verify that the natural gas distribution services were assigned in associated form by the local authorities served, by means of a number of distribution plants belonging to the company Ascopiave within the locality of Conegliano from the viewpoint of the exact identification of the tariff limits. 05.28.2008		Amendment to Annex A to Authority for Electricity and Gas Resolution No. 111/06 of 9th June 2006, for the revision of the procedures by which Terna intervenes in the day ahead market if the supply is insufficient, and also for the purpose of setting the value of power not supplied if the Emergency Safety Plan of the Electricity System is applied. The Authority makes a series of amendments to the regulations governing merit order dispatching (Resolution No. 111/06). The most important is the introduction of the value of power not supplied as a parameter for use in defining and settling transactions if the Emergency Safety Plan of the Electricity System is implemented. 05.28.2008		Start of fact finding investigation for the adoption of measures by the Authority for Electricity and Gas concerning standard service contracts for the distribution of natural gas pursuant to article 14, paragraph 1, of Legislative Decree No. 164 of 23rd May 2000. In observance of the provisions contained in Decree-Law No. 159/07, the Authority has started a fact finding investigation to acquire data and information needed to define intervention to be performed by the regulator with regard to the standard service contract for natural gas distribution activity. 05.27.2008		Postponement of deadline for payment of specific tariff prices by customers with medium voltage supply served by small size distributor companies. The Authority has amended article 37 of the electricity services quality code for the period 2008-2011 allowing MV customers served by small size distribution companies to have sufficient time (from 30th June 2008 until 1st January 2010) to bring their plants up to the technical standards set by the Authority under article 35 of that code. The date for payment of the specific tariff was also postponed for those customers.	ARG/elt 66/08
05.27.2008		Start of a fact finding investigation and of the consequent procedures for determining the conditions for the supply of gas other than natural gas in the geographical areas served by the companies COLSAM S.p.A. and SAC Petroli di Perotto Marco S.a.s. for the thermal years running from 2001/2002 to 2007/2008. The Authority starts procedures to ascertain in which geographical areas the companies COLSAM S.p.A. and SAC Petroli di Perotto Marco S.a.s. supplied gas other than natural gas without making the communications required by resolutions 237/00 and 173/04 and also to ascertain the tariffs actually applied and those which should have been applied. 05.27.2008		Extension of the deadlines for concluding the procedures started with Resolution No. 173/07 of 12th July 2007 to re-examine requests, to verify and certify energy savings and to exercise self protection powers if necessary. With Resolution No. 173/07, the Authority extends until 30th September 2008 the deadline for the conclusion of procedures started against the company Edihouse 2002 s.r.l., concerning two requests for verification and certification of energy savings. 05.26.2008		Formation of a new group to co-ordinate with consumer associations for rapid acquisition of information on common practices among operators with regard to end user customers, on complaints concerning general issues and on proposals to improve regulation and strengthen consumer protection. The Authority forms a working group to collect reports on common practices among operators, complaints on general issues and proposals to improve regulation and strengthen consumer protection. The Authority establishes that the group will be composed of the senior management directors of the Authority involved, of 3 representatives of domestic consumers and 2 representatives of non domestic consumers.	n. 026/08
05.21.2008		Urgent measures for the determination of the amounts relating to the electricity dispatching service for 2005. The Authority considered it necessary to establish invoicing procedures for dispatching service payments that are not covered by resolutions No. 118/03 and No. 168/03 and it therefore decided that the quantity of electricity supplied and withdrawn for 2005 subject to invoicing for dispatching service payments are not subject to further invoicing. The Authority decided that quantities subject to adjustments should be invoiced in accordance with annex A of this resolution. Finally the Authority decided that the balance between revenues and expenses resulting from what has just been described is to be charged to Terna within the following six months.	ARG/elt 65/08

The Authority decided amendments to special tariff regimes for the Ferrovie dello Stato (State Railways). This intervention explicitly regulates the practical procedures for revising the list of withdrawal points destined to supply electricity solely for railway use in compliance with the agreement regulated by Presidential Decree No. 730/63. 05.20.2008		Measures concerning the payment of the specific company equalisation contributions for the years 2005, 2006 and 2007 pursuant to Resolution No. 96/04. The Authority has instructed the electricity sector of the equalisation fund to pay on account by 30th June 2008, 80% of the amount paid for 2004 to the companies benefiting from specific equalisation contributions, for those sums due for each of the years 2005, 2006 and 2007. 05.20.2008		Instructions to the equalisation fund for the electricity sector on increases to tariffs made as advances on account to the company Elettrica Liparese s.r.l.. As concerns regulations to increase tariffs approved for minor electricity companies not transferred to ENEL, the Authority approves a resolution for an extraordinary increase for the company Elettrica Liparese (SEL), as payment on account and subject to settlement, which is additional to the payments made on account for 2007, amounting to 912,000 euro. 05.14.2008		Start of procedures to formulate measures concerning the technical and economic terms and conditions for connection to natural gas transport distribution networks. The Authority starts procedures for the definition of terms and conditions for connecting users to the national gas transport network. Resolution No. 166/05 currently states that until a specific measure is issued, contributions for connection to gas transport networks are determined on the basis of temporary criteria contained in the network code of the transport firm approved by the Authority. 05.14.2008		Start of procedures for the formulation of measures in accordance with article 2, paragraph 12, letter d) of Law No. 481/95. Stogit has presented a proposal for the update of the chapter "Injection and distribution booking and commitments" of the storage code in order to revise the procedures for gas and capacity sales following the implementation of the storage trading IT system. Procedures were therefore started by the Authority to verify whether the conditions exist for amendments to provisions concerning: 1) the amount requested by Stogit for management of the relative transactions (article 12.4 of resolution No. 119/05) for each request for transfer for valuable consideration; 2) the responsibility, on the part of the transferring user, for the payment obligations assumed with regard to Stogit by the user receiving the transfer. 05.14.2008		Approval of proposals for amendments to the storage code made by the company Edison Stoccaggio S.p.A. in accordance with article 19 of Resolution No. 119/05. The Authority has verified the conformity of the proposals from Edison Stoccaggio concerning possible amendments to the storage code with regulations for access to and provision of the storage service. These proposals for updating the services relate to: 1) elimination of the pooling service; 2) update of the regulations for the interest rates for payments in arrears; 3) correction of material errors encountered. 05.14.2008		Approval of the programme of inspections for 2008 of electricity distribution companies with regard to service continuity data for 2007. The Authority approves a programme of 12 inspections for 2008 of electricity distribution companies designed to verify compliance with obligations for recording power interruptions with and without notice, short and long, and for calculating service continuity indicators communicated to the Authority for 2007. 05.14.2008		Partial increase of the staff of the equalisation fund for the electricity sector, in accordance with Art. 12, paragraph 3, of the regulations attached to the Authority for Electricity and Gas Resolution No. 22/07, concerning the "new regulations for the organisation and functioning of the equalisation fund for the electricity sector". Following further duties entrusted to the equalisation fund of the electricity sector for the creation of an energy consumer information centre, the Authority approves an increase in its staff members by an additional 7 persons. 05.14.2008		Establishment of an information centre for energy consumers by the Authority for Electricity and Gas and the adoption of regulations for performing preparatory and investigative activities and communications when assessing claims and complaints presented by end consumers in accordance with article 2, paragraph 12, letter m) of Law No. 481 of 14th November 1995. The authority sets up an energy consumer information centre, an instrument for receiving and assessing complaints, reports and observations made by end consumers through different channels including a call centre. The activities mentioned will be financed by the equalisation fund for the electricity sector. The centre will be flanked by a group which co-ordinates consumer associations in order to identify and report conduct by operators that is harmful to the interests of the end consumers.	GOP 28/08
05.09.2008		Provisions concerning the terms and conditions for the protected service (electricity and dispatching prices), registration and disclosure of withdrawal data obligations and consequent updating of the sales code and the load profiling code. The Authority approves amendments to the sales code (Resolution No. 156/07) and the load profiling code (Resolution No. 278/07). The main changes are as follows: a) from 1st January 2009, the application of different prices for the electricity and dispatching component for different times of the day and in different seasons of the year for all non domestic services in protected categories with available wattage of greater than 15 kW equipped with an electronic meter; b) from 1st April 2009, the application of different prices at different times of the day and in different seasons of the year for all non domestic customers in protected categories with available wattage of not greater than 15 kW, equipped with an electronic meter; c) from 1st January 2010 the application of the electricity and dispatching price component with prices differentiated on a two hourly basis by season for all domestic customers still in protected categories, equipped with an electronic meter. Application is automatic for all after a transition period in which suppliers provide details in bills of consumption with prices differentiated by time bands.	ARG/elt 56/08
05.09.2008		Determination on actual figures for 2007 of costs for decommissioning abandoned nuclear power plants at the end of the fuel cycle and all the related and resulting activities. The Authority recognises the actual figures for 2007 of the costs incurred by Sogin for work performed to decommission abandoned nuclear power plants at 178,2 million euro and the expenses relating to the taxation on those activities. The Authority approves the reimbursement of the latest expenses incurred by ENEA for the reinforcing of flood protection structures amounting to 0,5 million euro.	ARG/elt 55/08
05.06.2008		Approval of the value of the specific company correction factor for the company ASSEM S.p.a. of San Severino Marche concerning revenues admissible to cover distribution costs for the year 2004 pursuant to Authority for Electricity and Gas Resolution No. 96/04 of 22nd June 2004 with subsequent amendments and additions. The Authority sets the specific company correction factor concerning revenues admissible to cover distribution costs regulated by Resolution No. 5/04 for the company Assem S.p.a. for 2004 at 0.2378 and instructs the electricity sector equalisation fund to pay that company the amount relating to the company's specific equalisation contributions for 2004. 05.06.2008		Amendment to attachment A to Authority for Electricity and Gas Resolution No. 48/04 of 27th March 2004 concerning the electricity dispatching order in compliance with Presidential Decree of 13th April 2007. The Authority amends Resolution No. 48/04 by applying a ceiling on the average cost of transmission capacity (CCT) incurred by operators with bilateral contracts, introduced with Resolution No. 137/04, for the periods from 1st April 2004 to 31st December 2004. Previously that limit had only been valid from 1st August 2004. The cost resulting from the equalisation borne by Terna S.p.A. is covered by the residual economic margin for 2004/2005 resulting from the application of transmission capacity costs and firm transmission costs. 05.06.2008		Amendment to article 1 of Authority for Electricity and Gas Resolution No. 195/02 of 29th November 2002, on methods of updating the part relating to the cost of raw materials in the terms and conditions for the supply of natural gas. The Authority postpones until 30th September 2008 the time limit for the decision concerning the extension until 30th June 2009 of the recognition of the fixed payment and a greater index linkage with oil prices in the gas raw material cost component. 04.22.2008		Determination of the equalisation value for 2007 of the fuel cost avoided pursuant to Section II, point 2, of the Inter Ministerial provision on prices No. 6/92 of 29th April 1992. The Authority determines the equalisation value of the fuel cost avoided pursuant to regulation CIP 6/92 for initiatives which benefit from incentives contained in that same regulation, and establishes that those equalisation amounts constitute the advance payments for 2008. 04.22.2008		Imposition of a fine in accordance with article 2, paragraph 20, letter c) of Law No. 481 of 14th November 1995 to the company Snie Spa. The Authority imposes an administrative fine of 54.600 euro on the company Snie Spa. The fine is the outcome of verification by means of an official investigation of the failure to send accounting information to the Authority in accordance with resolutions No. 61/99 and No. 310/01 for the years 2000 and 2004 and for the preparation of financial statements for 2001-2002-2003 which failed to comply with Resolution No. 310/01. 04.21.2008		Update, for the year 2007, of the terms and conditions for withdrawal of electricity within the meaning of article 13, paragraphs 3 and 4 of Legislative Decree No. 387 of 29th December 2003, following the decision of the Council of State on appeal case No. 4777/07. Following the annulment by the Council of State of the provision of Ministerial Decree of 24th October 2005 which regulated the terms and conditions for the "dedicated withdrawal" of electricity, the Authority annulled point 1 of Resolution No. 318/06, established that producers may modify the price of electricity withdrawal up until the end of May and allowed grid operators which have arrangements with producers for "dedicated withdrawal" to make any equalisations that may have resulted from the application of different economic conditions resulting from the annulment of the above-mentioned provision. 04.21.2008		Amendments and additions to the provisions of Authority for Electricity and Gas Resolution No. 348/07 of 29th December 2007, on special tariff regimes and specific measures for the company Ferrovie dello Stato S.p.A.. The Authority decided on amendments to special tariff regimes for the Ferrovie dello Stato (State Railways). The changes were as follows: a) direct management by the electricity sector equalisation fund of the application of the A and UC components to the withdrawal points of State Railways; b) unequivocal identification of the State Railways withdrawal points; c) recognition of the higher costs incurred by the State Railways with regard to the safeguarded category service. More specifically, the intervention relating to point c) consists of redefining: 1) the sales price applied to State Railways in the period 1st July 2007-31st December 2007; 2) the sales price applied to State Railways on the basis of Art. 74.5 of the transport code (Resolution No. 348/07); 3) the sales price of the compensatory tariff component established in Art.74.4 of the transport code. 04.15.2008		Start of fact-finding investigation into correct application of provisions concerning gas not recorded in accounts on the natural gas transport networks in the period 2004-2006. The Authority resolves to start an investigation to identify the causes of the unexplained and continuously increasing amounts of gas not accounted for in the pipelines for the transport of natural gas. The result of the investigation, scheduled to be completed within three months of its commencement, will determine the component of the transport tariff destined to cover the costs incurred for the compression of gas and to cover pipeline leakage. 04.14.2008		Determination of distribution revenue adjustments for the companies Acquambiente Marche S.r.l., AIMAG S.p.A., Arcalgas Progetti S.p.A., Coingas S.p.A., EGEA - Ente Gestione Energia e Ambiente S.p.A., Enel Rete Gas S.p.A., Enia S.p.A., Erogasmet S.p.A., Gestioni Valdichiana S.p.A., Intesa S.p.A., Iris - Isontina Reti Integrate e Servizi S.p.A., Italcogim Reti S.p.A., Molteni S.p.A., Pasubio Group S.r.l., Publireti S.r.l., SGR Reti S.p.A. and Veneto Distribuzione S.p.A.. The Authority has confirmed the validity of the gas distribution tariffs approved for the thermal year 2007-2008 and rejects requests to adjust distribution tariff regulations made by the companies cited. The applications made to make changes to the revenue tariff regulations made by these companies for the year 2002/2003 were not accepted and it was not therefore necessary to make any increases to the tariffs for the thermal year 2007/2008. 04.14.2008		Imposition of a fine in accordance with letter c), paragraph 20, article 2 of Law No. 481 of 14th November 1995, to the company ENI S.p.A.. The Authority imposed an administrative fine of 3 million 240 thousand euro on the ENI Group for violation of Art. 10.2 of Resolution No. 229/01. According to the Authority, ENI violated provisions concerning guarantees for the protection of end consumer customers that concerned information given to them. More specifically the conduct contested consisted of the communication of generic information which was therefore unsuitable for the purposes of the obligation to provide specific information as required under Resolution No. 229/01. 04.14.2008		Approval of the regulations for recording bilateral transactions for energy efficiency certificates pursuant to article 4, paragraph 1, of Authority Resolution No. 345/07 of 28th December 2007 and article 4, paragraph 1 of Ministerial Decree of 21st December 2007. The Authority approves the outline of the regulations for recording transactions concerning energy efficiency certificates. The Authority requires the electricity market administrator (GME) to provide and regularly update a "list of the operators enrolled on the energy efficiency certificate register" and to publish basic data on the operators listed in the register on its website. 04.09.2008		Start of a fact-finding investigation into raw material costs of Liquefied Petroleum Gas (LPG) and on other economic aspects of the non industrial market (GPL distributed through mains networks, or in tanks or cannisters). The Authority starts a fact-finding investigation into LPG costs and into other economic aspects of the non industrial market, taking account of sector regulations. The investigation will concentrate on the following aspects: 1) the charateristics of the product and diversification of uses; 2) sources of supply and the logistics of storage; 3) demand and supply for LPG in Italy 4) international prices of LPG; 5) transport costs; 6) distribution and sales of LPG. 04.01.2008		Start of official investigation for the imposition of administrative fines on AGSM Verona S.p.A. for matters regarding electricity tariffs. The Authority starts an official investigation into the company AGSM Verona SpA, an electricity distribution company, in order to ascertain the truth of violations encountered during an inspection performed in 2007 designed to investigate the proper application of electricity tariff rules. More specifically, it emerged that AGSM had offered its domestic end consumer customers (of the protected market) tariff options that were additional to the compulsory options without ever having submitted them to the Authority for approval and additional tariff options to non domestic end consumer customers (of the protected market) not comprised within the transport code. 03.31.2008		Exception to the electricity dispatching service and the transmission service regulations in cases of one dispatching user taking the place of another (switching) on withdrawal points owned by the company Rete Ferroviaria Italiana SpA, effective from 1st May 2008. The Authority postpones until 18th April 2008 the time limit for sending in switching applications for the withdrawal points owned by Rete Ferroviaria Italiana Spa. The purpose of the postponement is to allow Rete Ferroviaria Italiana Spa to take advantage of its right to abandon the current electricity supply regime on the safeguarded market to be able to obtain supplies on the free market and reduce the administrative costs of the safeguarded categories supplier. 03.31.2008		The start of procedures for drawing up the contents of the directory of withdrawal points and information flows related to them. The Authority starts procedures to define the minimum information content of the directory of withdrawal points and the procedures for communicating that content to dispatching users. It also grants a mandate to the Markets Director of the Authority to form a working group consisting of the interested parties, to organise meetings and to make recommendations to the Authority on these matters. The directory is an electronic register which distribution companies must keep for the withdrawal points located in their areas of operation and which must be sent monthly to dispatching users in accordance with Resolution No. 111/06. 03.31.2008		Update of the technical sheets for the quantification of energy savings relating to the installation of compact fluorescent lighting with ballast incorporated, high efficiency refrigerators, refrigerator freezers, freezers, washing machines, dishwashers, faucet aerators and low flow shower heads in residential environments, pursuant to ministerial decrees of 20th July 2004 and subsequent amendments and additions. The Authority updates some of the technical sheets for the quantification of savings achieved by energy efficiency projects (Resolution No. 234/02) and in particular with regard to the introduction of minimum requirements for the quality of projects and the measurement of the additional energy savings to be attributed to the projects. 03.28.2008		Regulation of the electricity dispatching service and the transmission service (transmission, distribution and metering) in cases of one dispatching user taking the place of another on the same active withdrawal point or attribution of a new or previously deactivated withdrawal point (switching). The Authority approves Annex A of this measure, which integrates electricity dispatching and transmission service regulations in order to ensure successful outcomes when customers switch from one supplier to another. More specifically the resolution defines: a) the criteria concerning the timing and the procedures which the various parties involved must adopt for each phase of the switching procedure; b) the information obligations of the dispatching user, of the protected categories supplier and the distribution company for the purposes of completing the switching procedures. The Authority reviews the storage quota payment in the terms and conditions of supply for non industrial users for the thermal year 1st April 2008 - 31st March 2009 (according to Resolution No. 138/03) for storage services, following the revision of storage tariffs made by ARG/gas Resolution No. 35/08. 03.28.2008		Terms and conditions for the supply of natural gas to protected category customers: update for the quarter April - June 2008. Determination of an increase to the payment for wholesale sales in accordance with the Decree of the Ministry for Economic Development of 29th September 2006. For the standard user (annual consumption of 1400 cubic meters), the quarterly update of the ‘terms and conditions of supply' for gas involved an increase of 4,2%, with increased annual expense of approximately 40 euro, inclusive of tax. The update brings the price of gas up to 72.30 euro cents per cubic meter, inclusive of tax and also includes a 0.1% share destined to the new fund for the supplier of last resort (introduced by a Ministry for Economic Development decree to ensure the security of supplies) and to storage tariffs for regional compensation due in compliance with the 2008 Finance Act. Net of tax the price is 45.05 euro cents per cubic meter, an increase of 5.8% compared to the previous quarter. As a result of the entrance into force of the Decree of 13th February 2008 (which completes the process of harmonising duties, to give greater standardisation across different geographical areas of the country) with which the Ministry for Economic Development reduced the duties on natural gas with effect from 1st January 2008, it was possible to contain price increases for the standard user with retroactive effect from 1st January 2008. 03.28.2008		Update for the quarter April - June 2008 of the tariff components destined to cover general electricity system charges and of additional components and provisions for the electricity equalisation fund. The authority updates the tariff components A, UC and MCT for the quarter April - June 2008 destined to cover general electricity system charges. In detail the Authority makes the following changes: a) it decreases the average rate for the component A3 taking account of the need to gradually repay the sums advanced from the account A6 and of the probable additional cost connected with the balance on fuel costs avoided recognised as payments on account in 2008 ; b) it decreases the rate of the tariff component A6. 03.28.2008		Update for the quarter April - June 2008 of the terms and conditions for the sale of electricity to protected categories. The Authority has updated the terms and conditions to be applied in the quarter April - June 2008 for the supply to protected category customers. In detail, the Authority decided: a) to increase the average annual cost of purchasing electricity for the single buyer with respect to the first quarter of 2008 and consequently to adjust the factor PE; b) to increase the estimated average annual cost of dispatching electricity for the single buyer compared to the first quarter of 2008, and consequently to adjust the factor PD; c) to increase the level of the component UC1, setting it with the objective of covering the costs until the end of 2008 relating to the UC1 account for 2007 with the consequent elimination of that component, unless there is a need for further recoveries relating to the protected categories market. 03.28.2008		Update of the conversion factor for kWh into ton oil equivalents, in relation to the energy efficiency certificates mechanism. The Authority updates the kWh/toe conversion factor used for the application of energy efficiency regulations setting it at 0.187 x 10^-3 toe/kWh. 03.27.2008		Urgent provisions for the start of hourly treatment for the purposes of dispatching for low voltage withdrawal points with available output of greater than 55 kW (amendments to Annex A of Resolution No. 278/07 - load profiling code). The Authority postpones from 1st April 2008 to 1st October 2008 the hourly treatment for the purposes of dispatching for low voltage withdrawal points with available output of greater than 55 kW, which are not treated hourly as at 31st March 2008. The resolution maintains the obligation to meter hourly withdrawals for those withdrawal points, as required by the load profiling code (Resolution No. 278/07), and to provision of data in accordance with the sales code (Resolution No. 156/07) and Resolution No. 111/06, in order to allow dispatching users with those withdrawal points in their contract to be properly informed of the hourly withdrawals made. 03.27.2008		Start of official investigation into the company Sime S.p.A. on access to the gas distribution service, for the purpose of adopting rulings in accordance with article 2, paragraph 20, letters c) and d) of Law No. 481 of 14th November 1995 in compliance with Presidential Decree of 18th January 2007. The Authority starts an official investigation into the company Sime S.p.A. on access to the natural gas distribution service. The Authority had already fined that company for refusing access to its distribution network by the company Dalmine Energie Spa. Nevertheless it was necessary to start new procedures both because of the partial success of an appeal by Sime S.p.A. and as a result of reports of continued refusal to grant access to the grid. 03.26.2008		Approval of corporate payments and determination of standard payments for storage activity for the thermal year 2008-2009, to implement Authority for Electricity and Gas Resolution No. 50/06 of 3rd March 2006. The Authority approves the new storage tariffs for the thermal year April 2008 - March 2009. These tariffs include the revenue corresponding to the compensatory contribution in the period 1st January 2008 - 31st March 2009 (quantified on the basis of estimates furnished by the Ministry for Economic Development and calculated with reference to the value of 1% of the revenue quotas RSS and RSD for the thermal year 2008-2009, increased by 25% to take account of the validity of the compensatory contribution from 1st January 2008) in the parameter Y of the gas handling/storage payment (variable storage payment),. With regard to the terms and conditions for electricity distribution grid connection, the Authority recognises the CEI (Italian Electro-technical Committee) 0-16 standard for the terms and conditions of electricity grid connection for users who supply or withdraw electricity from distribution grids with a voltage of greater than 1 kV and it approves the document setting out the criteria for the application of the technical rules and the document setting out the procedures for the compilation and the presentation of the declaration of compliance with the technical connection rules. The Authority starts an official investigation into the company ACSM Spa to establish whether it has violated regulations concerning the recording of interruptions to the electricity distribution service contained in the Authority's code for the distribution, metering and sale of electricity in the 2004-2007 period of regulation (Resolution No. 4/04). 03.17.2008		Start of official investigation for the imposition of administrative fines on Isab Energy S.r.l., on Syndial S.p.A. and on Tecnoparco Valbasento S.p.A. for failure to comply with the obligation to purchase green certificates in accordance with article 11 of Legislative Decree No. 79 of 16th March 1999. Following a report by the Electricity Services Administrator (GSE) of the failure to comply with the obligation to purchase green certificates for the years 2003 - 2006, the Authority starts official investigations into the companies Isaab energy Srl, Syndial SpA and Tecnoparco Valbasento Spa. 03.13.2008		Start of procedures for the formulation of urgent rulings concerning the method of collecting, administering and distributing the compensatory contribution paid by the holders of concessions for natural gas storage pursuant to paragraph 558 of article 1 of the 2008 Finance Act. The Authority starts procedures for the formulation of ways to cover the compensatory contribution (introduced by the 2008 Finance Act) which storage companies must pay to the regions in which their sites are located. This contribution, which is equal to 1% of the value of the total storage capacity, must be covered by an increase in the storage tariff.	ARG/gas 32/08
03.13.2008		Start of procedures for the formulation of ways of paying possible extra costs for 2008 resulting from the application of the measures contained in paragraph 4, article 46-bis of Decree-Law No. 159 of 1st October 2007 converted with amendments by Law No. 222 of 29th November 2007 and subsequently amended by Law No. 244 of 24th December 2007. The Authority starts procedures for the formulation of ways of paying possible extra costs which natural gas distribution companies must incur following the increase in concession fees (increase of up to 10% of the revenue cap) introduced by municipalities on the basis of paragraph 4, article 46 of Decree-Law No. 159/07. More specifically the resolution: a) defines the withdrawal points for public lighting systems subject to hourly treatment; b) regulates the method for determining the electricity drawn each hour from withdrawal points not treated on an hourly basis for public lighting systems and for calculating the electricity for establishing dispatching service costs; c) defines communication obligations for distribution companies and for Terna. 03.10.2008		Postponement of the time limits for the entrance into force of Title III of Resolution No. 40/04 of 18th March 2004, concerning post gas meter safety. The Authority approves the proposal of gas distributors and sellers to postpone by one year (i.e. until 1st January 2009) the entrance into force of Title III of Resolution No. 40/04 which regulates the safety of user gas systems when these are modified or brought back into use. 03.10.2008		Start of official investigation for the adoption of rulings and the imposition of administrative fines with regard to Enel Distribuzione Spa for violations of rules concerning provision of electricity grid connection services. The Authority starts an official investigation with regard to Enel Distribuzione Spa into suspected violations of regulations concerning the provision of grid connection services and the possible imposition of administrative fines. As concerns low voltage connections, the violations concern delays in sending connection cost estimates and in performing the connections themselves and failure to pay indemnities for those delays. As concerns medium and high voltage connections, the violations concern delays in sending "minimum general technical solutions" and in performing the connections. Furthermore, the violations claimed concern failure to comply with criteria of economic savings, rationality and need in stating the minimum technical solutions for connection.	VIS 12/08
03.05.2008		Amendments and additions to Annex A of Authority for Electricity and Gas Resolution No. 156/07 of 27th June 2007, concerning the protected categories service awarded by means of competitive procedures. The Authority makes amendments to the sales code to take account of the conclusion of the transitory protection regime following the selection using competitive procedures of new protected category operators to provide the service from 1st May 2008. The following was performed in this respect: a) particulars identifying customers in protected categories which must be transferred from the old protected category operator to the new operator; b) it was established that the distribution company must provide the new operator with a copy of the contract for the electricity transmission and distribution service for the withdrawal points of the consumers in protected categories who will be served located in the catchment areas of the distribution companies; c) the communication obligations of protected category operators were established to monitor the effects of provision of the service to protected categories on competition on the retail market. 03.05.2008		Compensation of electricity marketing costs for protected categories service operators for 2008. A mechanism is introduced for 2007 to compensate and settle any differences between revenues from the application of the sales marketing revenues component and costs acknowledged for marketing activity to which all companies selling on the protected categories market, separated by company, must participate in (see Resolution No. 349/07). The amount of the compensation mechanism is equal to the difference between the sum of the revenues obtainable from applying the sales marketing revenues component to customer actually served in protected categories in 2008 and the admissible cost component equal to the admissible cost for 2008. The quantification of this last payment is made on the basis of actual costs recognised in annual accounts for 2008.	ARG/elt 25/08

02.29.2008		Request for information from the company Gruppo Gea S.p.A. concerning activity to sell electricity and gas to end users. The Authority requests the company Gruppo Gea Spa to send a series of items of information within 20 days on its commercial range "intelligent home for energy" to the Quality and Consumers' Affairs Dept. of the Authority. The intervention became necessary following a report by a distribution company of irregular requests for transfers concerning approximately fifty contracts for the supply of electricity to the same number of end consumers. The irregularity consists in the request by the Gruppo Gea Spa to take the place of end users in the supply contract as a customer of the protected categories service, conserving the terms and conditions practiced to the end users replaced instead of taking the place of the previous sales company as a supplier. 02.28.2008		Start of an official investigation into the company Edison S.p.A. for violation of measures concerning the economic terms and conditions for the supply of quotas of natural gas from gas deposits due to the State. The Authority starts an investigation into Edison S.p.A. concerning the methods used by the company to sell quotas of national production due to the State to the virtual trading point, linked to a minimum supply price set by Edison S.p.A. itself, in conflict with the provisions of Resolution No. 326/07. 02.27.2008		Annual 2008 operating plan for the Authority for Electricity and Gas. The Authority approves the 2008 operating plan with informative and non binding intent. The efforts of the Authority will be directed primarily to promote: 1) competition; 2) the efficiency of energy facilities; 3) the protection of consumers; 4) energy efficiency; 5) the implementation of regulations; 6) dialogue between operators and institutions; 7) the operational efficiency of its organisational structure.	n. 15/08
02.26.2008		Criteria for defining the average annual price for the sale of electricity pursuant to paragraph 3, article 13 of Legislative Decree No. 387/03 for the purposes of setting the market price for green certificates pursuant to paragraph 148, article 2 of Law No. 244/07. Quantification of the average value of that sale price. The Authority resolves that for the purpose of price setting for green certificates for 2008, the average annual price for the sale of electricity is equal to the arithmetic average of the prices paid for energy withdrawn under the "dedicated withdrawal" regime in 2007. That value is €67.12/MWh. For the years subsequent to 2008 that value will be equal to the arithmetic average on a national basis of the hourly zonal prices paid in the previous year for electricity withdrawn under the dedicated withdrawal regime. The Authority also resolves that the costs incurred by the Electricity Services Administrator for the collection of the green certificates will be paid from the account for new plants operating on renewable and similar energy. 02.26.2008		Amendment of Resolution No. 36/07 of 23rd February 2007 to comply with article 9 of the Ministerial Decree of 21st December 2007 and use of the equalisation fund for the electricity sector (new measures for the equalisation fund for the electricity sector for the payment of sums connected with energy diagnosis and final detailed design of energy savings intervention on public users pursuant to paragraph 2 of article 13 of the Ministerial Decree of 20th July 2004 and to Ministerial Decree of 22nd December 2006). The Authority amends Resolution No. 36/07 in order to implement regulations introduced by a decree of the Ministry of Development and the Economy of 21st December 2007 concerning the transfer to the regions of the resources necessary to perform energy diagnoses and other intervention prescribed in the specific programme with Ministry of Development and the Economy Decree of 22nd December 2006. Furthermore, the Authority provides the use of the electricity equalisation fund to verify the adequacy of the documentation sent by regions to the Authority for the purpose of obtaining the resources necessary for that intervention. 02.26.2008		Determination of specific primary energy savings objectives for 2008 for electricity and natural gas distributors subject to the obligations pursuant to the Ministerial Decrees of 20th July 2004 as amended and added to by the Ministerial Decree of 21st December 2007. In consideration of the national quantitative objectives to increase the energy end-use efficiency set by a Decree of the Ministry of Development and the Economy of 21st December 2007, the Authority determines the percentage of the objectives which must be achieved by each electricity or gas distributor for whom they are compulsory, i.e. by each distributor which has at least 50,000 end user consumers connected to their grid. The Authority has approved regulations for the communication of the information needed to calculate the equalisation amount for the natural gas storage service (paragraph 9.3, article 9, of Resolution No. 50/06 on storage tariffs) and for the calculation of excesses between the sum of the terms FCft and ARft-2 (the corrective factor and the revenues from storage balancing) and revenues recognised for new investments in storage capacity RSfNt, an excess that must be paid by 1st March of each year to the Equalisation Fund. 02.25.2008		Approval of methods for transmitting information needed for calculating equalisation amounts in accordance with paragraph 14.3 of article 14 bis of Authority for Electricity and Gas Resolution No. 166/05 of 29th July 2005. The Authority has approved in final form the existing regulations for the calculation of the equalisation on transmission tariffs (defined by Resolution No. 166/05), according to which each transmission company communicates the information necessary for calculating the equalisation amount to the Electricity Equalisation Fund within 30 days of the end of each thermal year (paragraph 14.5.bis of Resolution No. 166/05). 02.25.2008		Measures relating to the electricity equalisation fund concerning tariff increases due to minor electricity companies not transferred to Enel. The Authority has resolved that when formulating recommendations for the rates for tariff increases for the minor electricity companies, the Electricity Equalisation Fund should take account of the remuneration on capital (equity) in the years subsequent to 2003 calculated according the parameters updated by the Authority with Resolution No. 5/04 in the period 2004-2007 and No. 348/07 in the period 2008-2011. 02.22.2008		Approval of tariff proposals, adjustments and tariff setting for the distribution of natural gas for the thermal years 2006-2006, 2006-2007 and 2007-2008, and also requests for information from some distribution companies. The Authority has approved the tariff proposals of a group of natural gas distribution companies for the thermal years 2005-2006, 2006-2007 and 2007-2008: Nettis Gestioni srl, Gas Natural Distribuzione Italia spa, DGN srl. The Authority has also provisionally set the tariffs for the thermal year 2007-2008 for the companies Genia spa, DGN srl and Cogeser Distribuzione srl.	ARG/gas 19/08
02.21.2008		Equalisation of electricity supply costs for the protected categories service and definition of settlement mechanisms between the Single Buyer and protected categories operators following quantification of the amounts relating to load profiling. The Authority makes amendments to the sales code in order to define equalisation mechanisms for electricity supply costs incurred by each final consumer protected categories operator.	ARG/elt 18/08
02.21.2008		Measures relating to load profiling equalisation for the first quarter of 2008. The Authority resolves: a) to make the coefficients for dividing up the market calculated for February 2007 valid for March 2008 in accordance with Resolution No. 118/03; b) ensure that the equalisation amounts determined in accordance with Resolution No. 118/03 for 2008 are calculated on the basis of energy prices and dispatching payments applied in the first quarter of 2008; c) extend the application of the Load Profiling Code for the determination of the electricity withdrawn in each conventional two month period from single hour treatment withdrawal points also for the determination of the electricity withdrawn in the first quarter of 2008 for each single hour treatment withdrawal point from 1st April 2008; d) ensure that the electricity withdrawn in the first quarter of 2007 from hourly band treated points from 1st April 2008 is determined on the basis of the withdrawal data for the time 24.00 of 31st March 2008. 02.20.2008		Urgent measures concerning the publication of data on the change in residual area withdrawals following modifications to the hourly treatment of withdrawal points (Amendment to Annex A of Resolution No. 278/07 of 31st October 2007 - Hourly load profiling regulations). The Authority resolution makes some amendments to hourly load profiling regulations. In particular the Authority has established: a) that distribution companies continue to determine the "delta PRA" of their area, disclosing the value to dispatching users; b) that the periods for which "delta PRA" is calculated is changed from monthly to two-monthly, to take account of the start of the hourly treatment introduced by the hourly load profiling regulations; c) that the "delta PRA" is sent to the Authority to assist it in verifying the correct commencement of hourly load profiling methods. 02.20.2008		Renovation of procedures started with Authority for Electricity and Gas Resolution No. 208/05 to implement the decision of the Consiglio di Stato (Administrative Court), Section VI, No. 1866/05 of 3rd December 2004. The Authority has renewed the procedures started with Resolution No. 208/05 in order to verify the fairness of tariffs for the electricity wheeling service provided by the former AEM Milano for the company Becromal Spa and to ascertain the current requirements of Becromal for connection to the AEM Elettricità grid. 02.12.2008		Amendments and additions to article 6 of Authority for Electricity and Gas Resolution No. 138/03 of 4th December 2003 concerning economic conditions for the supply of natural gas to consumers. Article 6, paragraph 2, of resolution No. 138/03, which defines the terms and tariffs for the supply of natural gas to domestic consumers has been amended. This article defines the transport component of the conditions of supply and has been modified by the introduction of a unit variable cost (CVI - pursuant to resolution No, 277/07 as an increase in the transport tariff for the containment of gas consumption, i.e. technical interruptability) in the formula for calculating the QTVK for the relative transport of gas. 02.08.2008		Urgent measures for the provision of electricity sales service for protected categories (to safeguard consumers) pursuant to Law No. 125 of 3rd August 2007, in implementation of the Decrees of the Ministry for Economic Development of 23rd November 2007 and 8th February 2008. The Authority resolution has made amendments to resolution No. 337/07, which sets the regulations for the electricity sales service for protected categories (non residential consumers with more than 50 employees or with a turnover higher than 10 million euros). The Authority considered it necessary to put back the time limits for the presentation of tender bids, in order to allow operators to make appropriate assessments following the postponement of the start of this service from 1st April until 1st May 2008. Furthermore the Authority has changed the requirements for participating in tenders, by defining the procedures for admission by temporary groupings of companies.	ARG/elt 13/08
02.08.2008		Determination of the cap on distribution revenues for the company ASCOPIAVE S.p.A., following the decision of the Consiglio di Stato (Administrative Court) No. 3476/07 of 22nd June 2007. The Authority has confirmed the validity of the distribution tariffs for the thermal year 2007-2008 for the company Ascopiave Spa, approved by Resolutions No. 261/07 and 321/07, rejecting the request for modifications advanced by the company. 02.07.2008		Decisions for allocating storage capacities and daily peaks for the modulation service for the thermal year 2008-2009. The existing criteria for allocating storage capacity (priority of allocation for users with consumption of less than 200,000 mc/annum, confirmation of the procedures for determining the maximum that may be requested) were confirmed for the thermal year 2008-2009. At the same time a new working group was appointed to draw up new allocation criteria to introduce in the thermal year 2009-2010. 02.07.2008		Amendments to Annex A of the Authority for Electricity and Gas Resolution No. 156/07 of 27th June 2007 (TIV). The Authority made some amendments to the Sales Code with the application of a fixed quota contribution if a new withdrawal point is activated or a previous one is deactivated, and also if a consumer requests deactivation, independently of whether the supply is of a seasonal nature. 02.04.2008		The start of procedures to formulate measures concerning proposals to identify minimum geographical areas for tenders for awarding gas distribution concessions and additional provisions for measures pursuant to Resolution No. 225/07. In accordance with article 46-bis of the 2008 Finance Act, the Authority started procedures to determine the minimum size of geographical areas (optimum user catchment areas) for tenders for awarding natural gas distribution concessions on the basis of the efficiency and excellence of the provision of the service. As part of those procedures the Authority must also decide appropriate incentives for distribution companies to combine and merge.	ARG/gas 9/08
02.04.2008		Approval of the specific company correction factor for the company ASM Distribuzione Elettricità s.r.l., which took the place of the company ASM s.p.a., for revenues admissible to cover distribution costs for the year 2004, pursuant to Authority for Electricity and Gas Resolution No. 96/04 of 22nd June 2004 with subsequent amendments and additions. The Authority has determined the specific company correction factor for the company Asm Distribuzione Elettricità S.r.l., for revenues admissible to cover the distribution costs of ASM Brescia S.p.A. for the year 2004, as equal to 0.1378. 01.25.2008		Regulation of the electricity dispatching service and the transmission service (transmission, distribution and metering) in cases of consumers in arrears or non performance by the supplier The Authority approves a document to regulate electricity dispatching and transmission services for cases of consumers in arrears or non performance by the suppliers with the following objectives: a) to protect the credit of the operator selling the service if a consumer fails to pay, ensuring the supplier's right to disconnect the services, in observance of the principles of transparency and accurate information on timing and the consequences of non payment; b) to protect the consumer from the risk of remaining with no dispatching and transmission contract in the case of non performance by the supplier. The AEEG has also started co-operation with the Authority for the Protection of Personal Data in order to compile a list of insolvent customers. Finally the AEEG is sending an opinion paper to the government on the need to identify requirements for categories of consumers which cannot be disconnected.	ARG/elt 4/08
