Measures for the promotion of competition and of efficiency in the electricity supply for 2005
Following the consultation document 23/11/2004, the Authority for Electricity and Gas defines few indices to be calculated in order to prevent and contrast the market power exercise. Through these measures, the Authority tries to avoid strategic subtraction of capacity and the setting of too high prices by relevant operators in each area. In case of market power exercise the operator is obliged for 30 days to bid at a fixed price for all its plants in all the hours of the day and will be paid at the bid price instead of the system marginal price. |

Instructions to Transmission System Operator (GRTN) for the adoption of the transmission and dispatch code according to the Prime minister decree of 11 May 2004
The Authority for Electricity and Gas gives has instructed the Transmission System Operator (GRTN) on the subject of drafting the "network code", which is the set of technical rules for connection, metering and dispatch that govern the transport and movement of electricity over the grid. The main purpose of the new directives is to adapt the rules to the imminent unification of the national transmission grid's ownership and management (Terna/GRTN merger); publication of the code is a basic prerequisite for that change, as it will help ensure neutrality and transparency in transport and dispatch services. In formulating the directives, the Authority took account of the problems encountered during investigation of the blackout of 28 September 2003. They provide for the unification and harmonisation of all rules issued since the advent of liberalisation, confirming the Authority's commitment to simplifying regulatory matters, including for the sake of easing new operators into the market and thus encouraging competition. The main matters faced in the Authority's directives are: 1) the service of connection to the national transmission grid, 2) the service of transmission, 3) the service of electricity dispatch, 4) the electricity measurement service, 5) the service of aggregation of electricity measures for the dispatch. |

The resolution introduces in the Italian power market the Fixed Transmission Rights (FTRs): hedging instruments against the risk of congestion cost volatility (CCC) to avoid the volatility risk of the price of the capacity transportation use, similar to firm transmission rights used in foreign power markets. The Regulatory Authority for Electricity and Gas adopts the "Regulation of the organisation and functioning of Authority for Electricity and Gas" which concerns the components of the Authority and their functions, the methods for the adoption of provisions, the structure of the Authority and the specific goals of each direction. The aim of the Regulatory Authority for Electricity and Gas is to introduce in the Regulation the necessary modifications in order to adequate its internal organisation to the development project begun with the resolution n.82/04, on the back of the evolution of the institutional and operational contest that has involved the Authority. Moreover, the Authority wants to distinguish between the functions of direction and control assigned to the Authority itself and the managing functions assigned to the chief executive, through the operational coordination of the Structure. |

Definition of the criteria for the definition of natural gas distribution tariffs for the second regulatory lag
The Authority for Electricity and Gas has decided on the natural gas distribution tariffs for the period 1 October 2004- 30 September 2008. The main changes with respect to the previous regulatory period are: the method used for the calculation of the starting value of the distribution revenue constraint which is now based on the value fixed for the previous thermal year adjusted to the new X-factor (RPo) value and the new rate of return on capital; the decrease in the allowed rates of return on capital which are set at 7.5% (compared to 8.8% for the previous regulatory period); the augmentation in the X-factor within the price cap which is fixed at 5% (it was 3%) but limited to operating costs and depreciation. In the new system it will be possible to calculate the tariff for each distribution area by applying an area-specific coefficient to a pre-defined tariff structure that is uniform throughout the country. |

The Authority for Electricity and Gas defines rules to warrant a free access to gas distribution networks by shippers, suppliers and final customers. The measure establishes criteria for the creation of gas distribution codes. The criteria established for the distribution codes are drawn up by the distributors and approved by the Authority. The aim of formal inquest is the adoption of termination order against the conduct of Gnl Italia Spa, which is detrimental of the right of the potential users of the regassification terminal of Panigaglia. The duration of inquest is set at 50 days: in this period, the company Gnl Italia SpA is asked to justify its behaviour to the Regulatory Authority. |

Assignment procedures for 2004 of the electricity envisaged by the Decree of the Ministry of Productive Activities of 29 January 2004
Following the Decree of the Ministry of Productive Activities of 29 January 2004, the Authority sets out the conditions through which the TSO (GRTN) must sell the electricity produced by renewable and assimilated sources under the terms of CIP provision n.6/92 (see Minister of Productive Activities' decree of 21/11/00 as modified by the decree of 22/12/02). The Authority specifies the pro-rata mechanism allocating the productive capacity among the eligible customers both on annual and quarterly basis. The Authority makes provision that no company or group can hold capacity above 10% of the total available capacity. The assignment price is the addition of a fixed and a variable component. The latter depends on the Ct parameter and, as soon as the Power Exchange starts, on the Exchange prices. |

The Authority also approves proposal for basic tariff options for distribution and sale suggested by Aem Gas s.p.a., Bas s.p.a., Asm s.p.a, Valgas s.p.a. and Sinergia s.p.a. for thermal years 2001-2002 and 2002-2003. The tariffs apply from 1 July 2001 to 30 June 2002 and from 1 July 2003 to 30 June 2003. |

The resolution extends the STOVE regime till the starting date of the merit order despatch. It modifies some provisions envisaged by resolutions n.27/03 and n.67/03 in order to take into account the provisions of the resolution n. 5/04 and the assumption of responsibility of the Single Buyer: in particular it states that the buyer for the captive clients from the STOVE system is the Single Buyer instead of Enel. Furthermore it introduces a new element in the despatch rules, the "dis" component, to be paid from February 2004 by the eligible clients, in order to cover the cost of the despatching service supported by TSO (GRTN). |

Unified Code of Authority for Electricity and Gas's provisions concerning electricity transmission, distribution, metering and sale to the captive market services for the regulatory period 2004-2007 and provisions regarding connection fees
The Authority for Electricity and Gas has decided on the electricity tariffs for the transmission, distribution, metering and sale to the captive market services for the period 2004-2007. Main changes with respect to the previous regulatory period are: the method used for the calculation of the RAB which is now the historic cost revalued year by year; the increase of the value of the useful life of the grids, which implies lower annual allowed costs for depreciation; the increase in the allowed rates of return on capital which are set at 6.7% for transmission (plus a further 2% for new investments), 6.8% for distribution and 8.4% for metering and sale; the reduction in the X-factors within the price cap which are fixed at 2.5% for transmission and 3.5% for distribution; the introduction of a firm-specific equalisation mechanism to allow for the specific characteristics of the different distribution companies. The effect on the total tariff equates to a reduction of about 1% for 2004. |
