12.30.2003 settore Elettricità Rules for the supply of the public service of electricity despatch and for the provisioning of the necessary resources following an economic merit order, pursuant to articles 3 and 5 of the legislative decree n.79/99
The resolution will enter in force simultaneously with the power exchange and sets the rules for: subjects that have to sign a dispatch contract with the TSO (GRTN) classification of production and consumption units, assignment of the transmission rights, supplying of the despatch resources via an organised market and outside the market, must run plants, management of outages and planned maintenance, despatch charges, balancing rules and unbalancing prices, accounting of the measurements, provisional rules for the year 2004.

12.23.2003 settore Elettricità Quarterly adjustment for January-March 2004 of electric tariffs components and parameters
The Authority publishes the quarterly adjustment of electric tariff components PG, PGT, CCA, PV due to variation in the Ct parameter, and the values of components VE, A and UC. The Authority for Electricity and Gas confirms the values of all the components and parameters set for the previous quarter (see resolution n.109/03). The Ct parameter for the period January-March 2004 is thus equal to 3.984 Euro cents/kWh; the PG parameter is set at 6.054 Euro cents/kWh and the VE parameter at 0.09 Euro cents/kWh.

12.23.2003 settore Elettricità Extension of electric tariffs for the transmission, distribution and sale to the captive market
Waiting for the new tariff regulation for the period 2004-2007, expected by the end of January, the Authority for Electricity and Gas has decided to extend until the 31st January 2004 the electric tariffs for transmission, distribution and sale to the captive market in force in 2003 (see resolutions n.152/02 and n.153/02).

12.23.2003 settore Elettricità Provisions for the transition to the merit order dispatching
The resolution delays till February 1, 2004 the operation of the transitory despatching mechanism in force during the second half of 2003 (STOVE). Some changes are introduced. All the plants with more than 10 MVA of capacity are admitted without reserve requirements. The participation is compulsory for all the eligible plants, while previously there was just an option for some of them. Enel continues to buy, on behalf of the AU, the energy for the captive market on the STOVE. AU sells to Enel, as well, the imports from the bands allocated to the captive market for 2004.

The Authority for Electricity and Gas approves the proposals for basic tariff options concerning the gas distribution and supply to captive customers for a group of operators; the tariffs apply from 1 July 2003 to 30 June 2004. The Authority also approves proposal for basic tariff options proposed by Italgas for thermal years 2001-2002 and 2002-2003 and by Aes spa for the thermal year 2002-2003. The tariffs apply from 1 July 2001 to 30 June 2002 and from 1 July 2003 to 30 June 2003.

The Authority sets the economic conditions of the gas supply for the quarter January-March 2004. The index for natural gas purchasing costs based on international price trends of oil products, has recorded a variation of -8.5%, allowing a decrease in the QE parameter (which covers the procurement costs of natural gas) from 14.02 eurocents/mc to 12.83 eurocents/mc.

12.18.2003 settore Elettricità Methods and conditions for the assignment of the transport capacity for electricity import, export and transit through the national transmission grid for the year 2004
The Authority for Electricity and Gas, following the decree of the Ministry of Productive Activities of 17/12/2003, specifies the rules for the allocation of the interconnection capacity among Italy and neighbouring countries. The pro-rata mechanism is similar to that applied last year, except for the minimum capacity threshold on each frontier, that decreases from 3 MW to 1 MW. The Authority keeps the last year's provision that no company or group can hold capacity rights above 10% on each frontier, but includes in the calculation also the rights bought from foreign system operators. It assigns to TSO (GRTN) the organisation of a secondary market, both monthly and daily (or weekly). The TSO (GRTN) must define also the reduction coefficients, different for seasons and for day and night, to be applied to the total capacity in order to obtain the actual available capacity in each period.

12.17.2003 settore Elettricità Modifications to the resolution 151/03 on the interruptibility service
The resolution modifies the previous resolution n.151/03 on the interruptibility service. Given the fact that there will be an additional allocation of instantaneous interruptible bands regarding 2004 imports, it gives to the assignees the possibility to renounce to their rights and receive the remuneration provided by the resolution n.151/03.

12.12.2003 settore Gas Adoption of provisions about insurance for small final customers of natural gas distributed by local pipelines
The Authority for Electricity and Gas makes compulsory the minimal civil responsibility, accident and fire (due to natural gas utilisation) insurance in favour of small final customers of natural gas distributed through local pipelines and extends it for the next four years. The cost for each customer, which will be covered by an additional component to the final tariff, does not increase and is 0.40 € per year. The insurance company will be selected through a public tender by the Italian Gas Committee (Comitato Italiano Gas), which is the subject entrusted with the drawing up of a unique national insurance contract, replacing Stogit in this task.

12.12.2003 settore Elettricità Urgent measures on the remuneration of the interruptibility service
The resolution introduces, for the three years 2004-2006, an explicit remuneration for the interruptibility service provided by customers. The interruptibility with warning will be valued at 8 Euro/MWh, for the year 2004, while the instantaneous one will be valued at 21 Euro/MWh. The assignees who already have the interconnection transmission rights with instantaneous interruptibility for the year 2004 can decide to renounce to their import rights and be remunerated as stated above.

12.04.2003 settore Elettricità Definition of distribution service continuity improvements in 2002 and approval of applications for 2003 pursuant to articles 22 and 23 of the Unified Code of regulations concerning the continuity of the electricity distribution service
On the basis of the incentives/penalties mechanism defined by the Continuity Code and the collected data, the Authority defines the service continuity improvements for 2002 and calculates primes and penalties. Continuity data for 2002 show an average improvement of 17% in term of total outages duration per customer. Distribution companies received in aggregate 114.9 million Euro for continuity improvements (primes for € 146.7 million and penalties for € 31.8 million). Enel received primes for € 114 million, ACEA paid € 3.9 million for penalties. The Authority also approves the applications for the acknowledgement of sustained costs for maintenance of excellence continuity levels in 2003.

12.04.2003 settore Gas Criteria for the definition of the economic conditions for the gas supply to final customers and provisions about gas distribution tariffs
The Authority for Electricity and Gas has defined the economic conditions for the gas supply that supply companies have to offer to small customers (less than 200,000 mc/year) as from 1 January 2004, in case, together with other conditions. These prices, with the details of each component (transport, storage, distribution, wholesale trade, supply, energy), should be published on both the Authority's web site and the suppliers' ones. The efficiency gains obtained from 2001 and 2003 and 50% of wholesale prices reduction in 2002 have been transferred to consumers, causing a reduction in the average national tariff of about 0.77 Eurocents/mc (-2.3%). Cross subsidies between different areas will be gradually abolished in order to bring prices to actual costs in each area.

11.20.2003 settore Elettricità Warning on physical measures determination for the year 2002
The resolution concerns the application of the conventional network loss coefficients. The Authority found that, during the year 2002, distribution companies did not correctly apply the standard coefficients for network losses. It gives a warning to distribution companies for calculating losses as provided by the Annex A of the resolution n.228/01 and invites them to recalculate 2002 losses using the correct formulas for the sake of compensation of economic quantities.

The Authority provides for the methods to estimate the withdrawn electricity during each hour from withdrawal points not measured on an hourly basis, also for the settlement of despatch service, and the obligations of distributors concerning such conventional setting. On the basis of the conventional setting each despatch user, including the Single Buyer, is given a share of the "area residual withdrawal" and the settlement, on annual basis, is made after estimating electricity withdrawn in each withdrawal point and for each solar year.

The resolution modifies the terms of payment to generators which produce for the captive market. Enel has to pay 90% of the energy produced for this sake by generators other than by itself within the thirtieth day of the month following the one to which quantities are referred. The residual part (10%) has to be paid by the thirtieth day of the second month.

With resolution n.103/03, the Authority for Electricity and Gas establishes the guidelines for promoting energy saving in final consumption of electricity and gas. The main elements set by the resolution are:1) 3 evaluation methods of the projects (standardised, analytic and ex post); 2) minimum size of allowable projects (at least 25 toe/year for standardised, 100 ept in the first 12 months of measurement of parameters for analytic and 200 toe in the first 12 months for ex post evaluated projects); 3) types (3), size (1 toe) and duration (5 years) of energy efficiency certificates.

09.02.2003 settore Elettricità Revision of the remuneration of the energy produced for the captive market and for the despatching service during the second semester of 2003
The resolution modifies the composition of the hour blocks for the second semester of the year, for the production side only. The provision is aimed to reach a better correlation between the bulk regulated electricity price of the hour block and the actual level of demand, preventing customers from paying more than before. For this reason, at the end of the year, net revenues of producers are calculated as the difference between the revenues corresponding to the new hour blocks and the old ones. If the total net revenue is positive, the positive net revenues of producers are proportionally reduced in order to get zero total net revenue.

The Authority for Electricity and Gas approves Snam Rete Gas's new transportation tariffs on the national and regional networks for the thermal year 2003-2004. As in the past thermal year, and pursuant to Tar Lombardia resolution's n.130/02, the Sicilian Regional Government's tax on gas pipelines has been excluded from the transportation tariff. Due to greater gas capacity use than expected and price cap mechanism, transportation tariffs decrease on average by 8%.

The Authority publishes the quarterly adjustment of electric tariff components PG, PGT, CCA, PV, due to variation in the Ct parameter (variable unit allowed cost of electricity produced by thermoelectric plants using commercial fossil fuels), and the adjustment of components A and UC. The Ct parameter for the three months period July - September 2003 is equal to 4.276 Euro cents/kWh. The PG parameter is set at 6.346 Euro cents/kWh. This decrease has been driven by the recent downward trend in international fuels prices started after the end of the conflict in Iraq. On average, the reduction of the electric tariff for the captive market amounts to 1.3%.

The resolution institutes the STOVE, a mechanism for the procurement of the electricity for the captive market and the despatching services based on the economic merit order. The resolution establishes a mechanism for the remuneration of the reserve capacity and increases the payment for the electricity supplied to the captive market and to the GRTN in the real time, raising the component rf and the fixed part of the Pg. The resolution also defines a special tariff component UC5 for the grid losses covering, to be paid both by captive and eligible customers.

The Authority for Electricity and Gas introduces few modifications to resolution n.229/01, determining an indemnification automatic rifle to the customer in case the gas seller (or the distributor) doesn't estimate the consumption using an accessible measure group and conditioning to the presence of an accessible measure group the seller's obligation of sending a balancing bill. It also establishes that there's no obligation of allowing a payment by instalments in favour of customers with consumption until 5,000 mc per year in case of "anomalous" consumption estimates if the differences in consumption are caused by seasonal variations. The Authority postponed the validity period of resolution 229/01, fixing 31 July 2003 as the final term of validity for all the provisions.

04.01.2003 settore Elettricità Modifications to resolution n. 317/01 of 28 December 2001, regarding provisional rules for the supply of the electricity despatch service
The resolution confirms the balancing and settlement tariffs, stated by resolution n.317/01, for the period form April to December 2003 but introduces some modifications to the contractual obligations for the balancing and exchange contracts: final customers can have a single balancing and exchange contract for all the grid point in the territory of a single distributor, with a single mandatory; the signers of the contracts have the responsibility of the provisional measurements communications to the GRTN. The check of the existence of such contracts is entrust to distributors, which can refuse grid access in case of absence.

The Authority defines the rules for the allocation of the interconnection capacities among Italy and Greece. The total capacity is divided among capacity disposable for the overall period, reserved to eligible clients, and capacity disposable for lower periods, reserved to the franchised market. In case of capacity scarcity, a pro-rata mechanism is applied to the requests, with a lower bound of 3 MW for assigned bands. In case of transits form Italy to other countries to Greece, the GRTN is responsible to ask to HTSO the transport capacity in Greece. The assigned capacity can't be traded by assignees.

For the second quarter of 2003 the Italian Authority for Electricity and Gas has established changes in the gas supply tariff components and parameters. With regard to the previous level, the index for natural gas purchase costs, It, based on international price trends of oil products, has recorded a variation of more than 5%, allowing for a QE parameter increase of 0.0211 Euro cents/MJ (0.8128 Euro cents/mc). The updated level of QE parameter, which covers the procurement costs of natural gas, is set at about 0.3639 Euro cents/MJ.

03.24.2003 settore Elettricità Quarterly adjustment for April - June 2003 of electric tariff components and parameters
The Authority publishes the quarterly adjustment of electric tariff components PG, PGT, CCA, PV, due to variation in the Ct parameter (variable unit allowed cost of electricity produced by thermoelectric plants using commercial fossil fuels), and the adjustment of components A and UC. The Ct parameter for the three months period April - June 2003 is equal to 4.425 Euro cents/kWh. The PG parameter is set at 6.484 Euro cents/kWh. This increase has been driven by the upward trend in international fuels prices over the period September 2002 - February 2003, but the appreciation of the Euro over the Dollar and the reduction of the A3 component (covering the incentives to renewable sources) have helped in containing the electric tariff which, on average, has risen of 0.8%.

03.13.2003 settore Gas Adoption of transitory dispositions for the modification of the storage tariff applied by Stogit Spa in the period from 1 January to 31 December 2003
In order to cover Stogit costs related to residential gas customers insurance, the Authority introduces an additional tariff component for the seasonal load balancing storage service, valid from 1 January to 31 December 2003. This component is proportional to the (average) number of customers of the operator and to the national average insurance cost per customer. It is also established a temporary simplified form of the additional component, valid until 28 February 2004, which makes the component proportional to the total insurance costs weighted for the 2001 gas consumption share related to customers considered captive at the end of 2002.

03.13.2003 settore Elettricità Definition of criteria for the acknowledgement and the checking procedures of the eligible customer qualification and other informative duties
The Authority for Electricity and Gas establishes that in the first invoicing after 29 April 2003 distributors have to inform at least customers with an annual consumption superior to 0.1 GWh of their possibility to stipulate agreements with different operators and of their recess faculty, in case they are eligible customers. At the same time five public directories are instituted, related to eligible customers, distributors and wholesalers, foreign customers, consortia, generators. It is introduced the possibility for the different subjects to self-certificate their condition, under the Authority check.

The Authority for Electricity and Gas approved basic tariff options of a group of operators for the distribution and supply to captive customers services. The tariffs are effective from 1 July 2002 to 30 June 2003.

The resolution states the level of guaranteed revenues (RR) and of conventional production of Enel Spa plants for the years 2000 and 2001. Figures contained in table 1 and 2 are notified to Enel, but not published on the Internet site.

01.23.2003 settore Elettricità Definition of distribution service continuity improvements in 2001 and approval of applications for 2002 pursuant to articles 22 and 23 of the Unified Code of regulations concerning the continuity of the electricity distribution service
As regards as the Unified Code of Authority for Electricity and Gas regulations concerning the continuity of the electricity distribution service (resolution n.155/02) and on the basis of collected data, the Authority defines the service continuity improvements for 2001 and applies the system of incentives and penalties for the reduction of electricity outages by distribution companies. Service continuity data for 2001 display for the Enel Group an improvement, in terms of average number of outages, of 9%. During 2001, distribution companies have received for quality improvements 31.4 million Euro, equal to the difference between incentives (65.6 million Euro) and penalties (33.2 million Euro), which correspond to nearly 1 Euro per customer. In addition, the Authority approves the applications for the acknowledgement of costs sustained by operators for the maintenance of service continuity levels in 2002.

01.23.2003 settore Elettricità Definition of urgent provisions concerning the withdrawal from electricity annual supply contracts and the assignment to the captive market of electricity envisaged by article 3.12 of Bersani decree n.79/99
The Authority, by modifying resolution n.158/99, reduces the notice time needed for the withdrawal by electricity annual supply contracts with distributors for those eligible clients, previously supplied by distributors, who have gained short term import capacity or Cip6 capacity: the notice time is shortened from 1 month to 5 days. Moreover, the Authority establishes that, until the withdrawal is effective, the Cip 6 pertaining electricityto the eligible clients is sold by the TSO (GRTN) to the captive market.
