12.27.2002 settore Efficienza energetica settore Elettricità settore Gas Definition of electricity and gas quantities distributed on national territory in 2000 and self-certification of electricity and gas quantities distributed by distribution companies pursuant to decrees of 24 April 2001
In order to determine the quotas of national end-uses efficiency targets pertaining to distribution companies starting from 2002, the Authority publishes the overall electricity and gas quantities distributed on the national territory in 2000, which are respectively 204 TWh and 1.16 billion GJ. Pursuant to decrees of 24 April 2001, the single distribution company's quota has to be calculated by dividing its own electricity and gas quantities distributed by the national quantities. By 30 April 2003, distributors must certify to the Authority the quantities distributed in the previous year.

12.23.2002 settore Gas Quarterly adjustment for January-March 2003 of gas supply tariff components and parameters for captive customers
For the first quarter of 2003 Italian Authority for Electricity and Gas has established changes in the gas supply tariff components and parameters for captive market. With regard to the previous level, the index for natural gas purchase costs, is based on international price trends of oil products, has recorded a variation of more than 5%, allowing for a QE parameter increase of 0.0227 Euro cents/MJ. The updated level of QE parameter, which covers the procurement costs of natural gas, is set at 0.3428 Euro cents/MJ.

The Authority publishes the quarterly adjustment of electric tariff components PG, PGT, CCA, PV due to variation in the Ct parameter (variable unit allowed cost of electricity produced by thermoelectric plants using commercial fossil fuels), and the values of components VE, A and UC. The Ct parameter for the period January-March 2003 is equal to 4.106 Euro cents/kWh. The PG parameter is set at 6.165 Euro cents/kWh. The increase in international fuels prices during the period June-November 2002 has caused a rise in the Vt parameter (unit allowed cost of fuels), but the appreciation of the Euro over the Dollar has helped in containing the electric tariff. On average, the rise in the electric tariff is 2.5%.

12.23.2002 settore Elettricità Recovering of extra wholesale costs raising from the implementation of art.11 of Bersani's Decree
The art.11 of Bersani's decree n.79/99 requires all producers from conventional fossil fuel sources and importers, with an annual electric flow higher than 100 GWh, to introduce every year (starting from 2002) in the system electricity from renewable sources for an amount of at least 2% of their own production or imports recorded in the previous year. The amount of green energy can be purchased in the Italian Green Certificates Market. The Authority has introduced a new tariff component, VE, for the captive market allowing for the recovering of these purchasing extra-costs sustained by producers and importers and then charged to retailers or distributors with regard to the electricity volumes the latter sell to the captive customers. For the first quarter, the component VE amounts to 0.09 Euro cents/kWh.

The Authority establishes that Enel will be responsible for the usage of the interconnection capacity reserved to the captive markets, besides that reserved to long term contracts (200 MW), provisionally till the effectiveness of the single buyer. An incentive mechanism assures that the surplus derived from the spread prices between Italy and foreign countries will be shared between Enel and the captive market.

The Authority modifies resolution n.47/00 concerning the discipline of general and specific commercial quality levels of gas distribution and sale. The Authority for Electricity and Gas modifies resolution n.201.99 concerning the discipline of general and specific commercial quality levels of electricity distribution and sale in order to take into account both the reduction in the eligibility threshold and the unbundling of distribution and sale activities. In particular, the Authority extend the regime to all medium and low voltage customers; establishes the respective obligations of distribution and sale companies; envisages the graduated extension of the discipline on quality levels also to companies with less than 5000 low voltage customers.

12.19.2002 settore Gas Adoption of an action, pursuant to article n.2.20.d of law n.481 of 14 November 1995, towards Snam Rete Gas
The Authority for Electricity and Gas establishes that Snam Rete Gas must remove, within 30 days, a provision included in the conditions for the transportation capacity allocation for 2002-2003 because it can compromise the third party access to the grid. The provision envisaged the possibility for Snam Rete Gas to refuse access to shippers that had not yet paid capacity charges already expired.

In resolution 211/02 the Authority for Electricity and Gas publishes the results of the check on basic and special tariff options for the electricity transportation and on additional tariff options for the sale to the captive market presented by operators for 2003 (172 operators have presented basic and 32 special tariff options, whereas 11 have submitted additional tariff options). resolution 211/02 also introduces a tariff regime that should be offered by operators for the period from 01/01/03 to 31/12/03 in cases where they have not presented basic tariff options for transportation (7 cases): they should apply the corresponding 2002 basic tariff options or, if impossible, the TV2 tariff.

12.12.2002 settore Gas Directive to natural gas suppliers to the final customers, in relation to article n.2 of the law n.481 of 14 November 1995
The Authority for Electricity and Gas establishes that natural gas suppliers to two categories of final customers, the captives at the end of year 2002 and the eligible that didn't stipulate new agreements, must continue to apply the conditions in force at 31 December 2002; it is however possible for the customers to accept new contractual offers. The offers to captive customers must follow the criteria established by a future Authority's provision and to be published by 31 march 2003.

12.12.2002 settore Elettricità Definition of competitive procedures for 2003 for the transfer by the TSO (GRTN) of the electricity envisaged by article 3 (12) of the legislative decree n.79/99
The Authority sets out the conditions for the competitive procedures through which the TSO (GRTN) must sell the electricity produced by renewable and assimilated sources under the terms of CIP provision n.6/92 (see Minister of Productive Activities' decree of 21/11/00 as modified by the decree of 22/12/02). The Authority defines the mechanism allocating the productive capacity both on an annual and monthly basis. The resolution defines three different auctions regarding eligible customers willing to accept planned outages, willing to improve their consume in F4 hours and others; minimum bid prices are published. Bands are allocated following a decreasing bidding price order.

The resolution n.203/02 sets interim wholesale prices for 2003 for the electricity to captive market to be applied until the bidding system is launched and the AU starts its activity. In particular, the wholesale price component covering fixed generating costs, which is differentiated into time bands (see Authority for Electricity and Gas resolution n.205/99), is determined according to the allowed production costs for thermoelectric plants and reference production levels. With respect to 2002 fixed components, no changes have been set.

11.29.2002 settore Elettricità Postponement of the deadline for the conclusion of the procedure concerning electricity service continuity for 2001
The Authority postpones the deadline for the conclusion of the procedure concerning continuity of the electricity distribution service for 2001. In accordance to the unified code on continuity (resolution n.155/02), within 30 November the Authority must determine the reductions in outages achieved by distributors in the previous year and eventually acknowledge to them costs for the achievement of continuity improvements in the current year. The deadline is postponed to 31 January 2003.

11.29.2002 settore Gas Methods for the revision of the energy component of the gas tariffs, following law n.238 of 28 October 2002, and modifications of other resolutions
The Italian government freeze on gas prices has expired at the end of November and the revision of the tariff mechanism comes into effect with resolution n.195/02. Under the new price mechanism, gas supply tariffs to the captive market can only be reviewed and altered on a quarterly basis and not every two months, as is presently the case. Increases in gas tariffs will be based on average changes in international prices in the nine months leading up to the quarter in question rather than six months. Finally, the invariance threshold remains unchanged at 5%. In accordance with the new method, gas tariffs will remain unchanged in December with respect to the values set in July (resolution n.122/02). The variable cost-component Qe, representing the gas procurement for distributors linked to the wholesale gas markets, is stable at 0.3151 €cents/MJ (12.139 €cents/mc).

11.29.2002 settore Elettricità Methods for the revision of electricity tariffs components, following law n.238 of 28 October 2002, and modifications of other resolutions
The Italian government freeze on electricity prices has expired at the end of November and the revision of the tariff mechanism comes into effect with resolution n.194/02. Under the new price mechanism, electricity tariffs to captive market can only be reviewed and altered on a quarterly basis and not every two months, as is presently the case. Increases in electricity tariffs will be based on average changes in international fuel prices in the six months leading up to the quarter in question rather than four months. Finally, a higher invariance threshold is set (3% instead of 2%). In accordance with the new method, electricity tariffs will remain unchanged in December with respect to the values set in July (resolution 123/02): the Ct parameter is equal to 3.941 Euro cents/kWh, whereas the PG parameter is set at 6.00 Euro cents/kWh. A and UC components values remain those of the bimester March-April (resolution n.24/02).

11.21.2002 settore Elettricità Methods and conditions for the assignments of the transport capacity for electricity import, export and transit through the national transmission grid on the north frontier for the year 2003
The Authority defines the rules for the allocation of the interconnection capacities among Italy and neighbouring countries. The total capacity is divided among franchised market (2255 MW), capacity reserved to Switzerland, Austrian and Slovenian authorities (1500 MW), capacity reserved to interruptible eligible customers (1200 MW of which 600 already allocated last year) and capacity reserved yearly to other eligible customers (1445 MW). In case of capacity scarcity, a pro-rata mechanism is applied to the requests. No company or group of companies can hold capacity rights above 10% on each frontier. The capacity right will be lost by the operators which use less than 80% of their availability. TSO (GRTN) should organise a secondary market, both monthly (or weekly) and daily, for the adjustments between operators, new capacity that could become available during the year, spot quantities. Following the agreement with CRE the allocation of the total interconnection capacity with France is managed jointly by TSO (GRTN) and RTE.

The Authority for Electricity and Gas and the Commission de Rigulation de l'Electriciti have signed, on 21 November 2002, an agreement on interconnection allocation rules for the frontiers between Italy, France and Switzerland. Switzerland firms will allocate half of the capacity with Switzerland, while the other half and the total capacity with France will be allocated jointly by TSO (GRTN) and RTE. The allocation mechanism will be the pro rata, yearly and daily for additional available capacities. The two regulators invite Switzerland firms to join the agreement.

The resolution declares that the rules for the allocation of interconnection capacity by TSO (GRTN) set by article 12.1 and 12.2 of resolution n.301/01 (Enclosure A) are to be applied to all the frontiers excepted the one with France. The free capacity with France is to be allocated for a maximum quote of 50% by TSO on a daily basis, for the other 50% by Riseau de transport d'ilectriciti (the French transmission system operator), following the procedures set by the agreement between TSO and Riseau de transport d'ilectriciti, Annex 2. These rules are valid until the end of 2002.

The Authority for Electricity and Gas updates the electric transport service fees for 2003 in accordance with the price cap method both for non-domestic (TV1 tariff option) and domestic users (D1 tariff). In particular, inflation accounts for 2.5%, while costs reduction for 4%. However, allowed costs for the distribution service increase owing mainly to substantial service continuity improvements achieved in 2001. On average, electricity transport prices will rise of 1.3%.

08.01.2002 settore Elettricità Acknowledgement of priority access rights to the transport capacity on interconnections with foreign countries, pursuant to article 10 (2) of the legislative decree n.79/99, owing to the carrying out of new electric network infrastructures
The Authority for Electricity and Gas establishes priority access rights to the transport capacity on interconnections with foreign countries in favour of those who directly carry out new electric network infrastructures in line with the transmission grid development plans decided by the TSO (GRTN). The priority rights concern the 80% of the new available transport capacity with a ceiling of 800 MW and hold for ten years. Moreover, the new lines must become operative before 31/12/2007. The measure has been justified with the aim of stimulate investments on interconnections which, in turn, promote competition in the national electricity supply.

The Authority for Electricity and Gas approves Snam Rete Gas's new transportation tariffs for the thermal year 2002-2003 after that SRG initial proposal, which envisaged the inclusion of the Sicilian Regional Government's tax on gas pipelines in the transportation tariffs, has been rejected by the Authority with resolution n.120/02. Due to greater gas volumes and price cap mechanism, transportation tariffs decrease by 7%.

The TAR Lombardia resolutions n. 5286 and n.5288 dated 31/07/01 and the Consiglio di Stato resolutions n.390 and n.391dated 09/07/02 have cancelled the Authority for Electricity and Gas resolution n.238/00 in relation to the reduction of the fixed costs component in the electricity wholesale price as from 2001. Consequently, waiting for the grounds of the Consiglio di Stato resolution, the Authority for Electricity and Gas has decided to delay some of the terms envisaged by article 9 of resolution n.204/99, as modified by resolution n.228/01, concerning the certification of 2001 actual and allowed revenue and the possible refund to consumers by distribution companies.

07.17.2002 settore Gas Adoption of guarantees for third party access to gas transportation network and of rules for the arrangement of network codes
The Authority for Electricity and Gas defines a system of guarantees for third party access to gas transportation network which has to be incorporated in network codes. The new rules can become effective as from next thermal year starting in October 2002. Major provisions are: right of priority for the transportation capacity allocation at the entry points of national network for TOP contracts first and, subsequently, for long term contracts (within the contracted average daily quantity); allocation method pro-rata when capacity is inadequate with respect to demand (respecting priority rights at the entry points of the national network); priority right to transportation capacity for investors in new pipelines (for a maximum of 80% of new capacity and 20 years). Moreover, the Authority envisages the introduction of a secondary transportation capacity market and a gas trading market on system, both regulated by the Authority itself. A network code model is given to Snam Rete Gas and Edison.

The Authority for Electricity and Gas sets new rules concerning the collection of tariff components A2, A3, A5, A6, covering general system costs, and changes the rules set in resolution n.228/01. In resolution n.228/01 these tariff components were considered as surcharges of transport tariffs both for free and captive market. In resolution n.124/02 the Authority establishes that the free customers will pay these components as surcharges of the balancing fees paid to TSO (GRTN). The TSO (GRTN) is allowed to retain the yield of component A3.

Hence, the electric tariff for the summer will be much higher essentially because of the rise in international fuels prices during the period February 2002 - May 2002.

In relation to the electricity sector, the bill AS1149 establishes that in order to maximise the use of interconnection capacity, the Ministry of Productive Activities can assign the transportation capacity on the interconnection lines to final users either subscribing real time interruptible contracts or assuring, on the basis of long term contracts, the use of at least the 80% of yearly capacity. Moreover, the bill states that bilateral supply contracts corresponding to this capacity allocation are authorised by the Ministry with a derogation to the power exchange system. The Authority for Electricity and Gas underlines that on the one hand the provision hurts the independent regulatory functions, on the other, it introduces not transparent and potentially discriminatory allocation mechanisms in contrast with the provisions of the European Union proposal of amended directive 96/92/CE.

The Authority has supplemented the regulation on electricity network access by setting the rules for requesting and implementing new connections. The provision concerns in particular the connection of new or repowered generating plants (for which at present there are connection requests for more than 100,000 MW) and of industrial consumption sites. The aim is to facilitate the construction of new power plants and to enhance competition. Requesting parties must pay a fee for the technical analysis of the new connection and may be asked to give a bank guarantee. Finally, requesting parties may implement directly the connection on the basis of the technical specifications defined by the network operator.

The resolution sets the criteria for acceding to the benefits envisaged by the electricity and gas liberalisation decrees for cogeneration plants. The Authority establishes that, in order to access those benefits, cogeneration plants are those satisfying two conditions: an index of energy saving of 10% for each new section of the plant (8% for repowered sections, 5% for existing sections) and at least the production of 15% of heat on the aggregate (heat and electricity) produced energy. The resolution differentiates the way in which these indicators -energy saved and quantity of heat produced- are applied on the basis of parameters such as the size of the plant section and the type of fuel used. In this way the Authority takes into account the difficulty of applying the same incentive criteria to plants which vary greatly in terms of technology and size (and, as a consequence, performance).

In particular, resolution n.36/02 regulates the economic settlement relative to the exchange of electricity. In order to guarantee greater flexibility to operators, the Authority envisages: the possibility of compensation through the transfer between operators of electricity belonging to different hour bands (new article 7 (4)); the possibility of compensation of the economic balances' sum relative to a two-months period with the balances' sum of the following two-months period (new article 7 (4.1)).

Service continuity data for 2000 display an aggregate average improvement of 8%. The return on the net capital invested is fixed at 8,33%.These criteria will be applied by Eni's storage affiliate Stoccaggi Gas Italia. The main innovations are the 4,5 kW contract (in addition to previous 3 and 6 kW contracts) and the two-tier tariffs (lower price for night consumption).
